Value of the car is VERY relevant. It is not realistic to expect somebody else to cover a £1500 bill on a £750 car.

    incompetant !!!!!!.

what happened is that they were tinkering around with the car and needed to test drive. They put theings back in a hurry and forgot to put a hose in. The water pump proceeds to empty the car out of coolant and overheated the engine.

No hose just comes out, a host clamp is a pita to remove without the right tools. Very firm and snug.

    Have any frauds taken place?

I have been without a/my car for over a year.....and I am told that it is 'unrealistic' that the garage who I think is responsible for me being without a vehicle, should pay.....thank you Adrian you have made my mind up I will be taking the said garage to court and see if they agree with you?

Good luck with that. See the ending to my post #5.

IF you win, then the most you will be awarded is the market value of the car, or whatever losses you've quantified and proven them to be responsible for, whichever is the lower.

How have you let the car stay with them for all this time?

I'm confused about the 370 miles. Is this based on the MOT record (where they might have mis-typed the mileage) or have you seen that it's got 370 miles more on than when you left it there?

I'm all for people and businesses facing up to their responsibilities, but you'll need to prove that the garage have been negligent and this may well turn into a stream of accusations and rebuttals with no clear winner. You're obviously very patient as you've let them keep the car for so long, and if it's all happened as you say then I hope you achieve the outcome you want.

Definately done 370 extra miles....it was also pointed out by Jaguar on the vehicle MOT history. They had the car 6 months couldn't really do a lot about it....it is now with a Jaguar dealership who are working on it taking notes and photos. I really didnt want to take the garage to court (it is a local business...) but after posting on here and reading comments I think win/lose I need my day in court. Thank you people I will let you know (eventually) how I get on.....

The car had passed the MOT before the engine blew, why then were they driving it, why didnt I get it back? I didnt give them permission to drive the car so where did the 370 miles come from

Obviously you asked them... what was the explanation?

.....why did it take a few weeks to deal with the minor details on the MOT (wiper blades, break light and ABS light), they didnt quote me for any repairs?

That dosn't make sense... if they hadn't quoted you then legally they can't force you to pay for the work unless you had a prior agreement about allowing work to be carried out up to a certain limit.

Why did they continue driving it when the top hose came off and they lost water?
I realise the servo (at least wasnt their fault which is why I kept ir out of the cuurent bill. I need answers which they will not give me....

Then your only option is to ask them in court.

You were in it at the time, were you?

Engines don't just blow up - especially not because of a cooling system fault !!

Don't forget if you lose they can ask the court to award them their costs such as travel etc.

You need to demonstrate the a) the damage was caused by them; b) they was negligent.

You've not even explained properly here what exactly they have caused and why so how you plan on persuading a judge they are the ones responsible for the fact your car is a lemon is beyond me.
