Cherished Reg problem

I purchased a car 5 weeks ago without receiving the log book & asked the owner had the timing chain given any problems, she said no but there was a light on in car but that it was nothing to worry about as it passed MOT with light on.
I took car to be checked & was told it needed a new timimg chain costing £550. After asking the woman again had she any problems she said no. Now she has sent me a letter to say the car was sold as seen, which I already knew, but the car was advertised with a picture showing a cherished plate, but when we went to buy the car, the woman said that she had sent log book away,now I still have not received a tax book - 5 weeks later, would I be within my rights to apply for a new log book for the cherished plate especially as she has stated the car was sold as seen?

    Hang about - with all that story of palaver, the thing you're most worried about is whether or not you can have the private plate?


    Does the timing chain issue not concern you in any way, or are you considering the vanity plate some sort of consolation prize?


    One thing to learn here - never buy a car without a V5, and never accept that a light on the dash isn't a problem just because the car passed an MOT.


    A car can pass and MOT without a working reverse gear, amongst other things, but you probably wouldn't buy one that could, would you?

    You bought a car knowing that it had a warning light on and no V5C.
    You bought it in a private sale.
    You've now found it has a problem totally unrelated to the warning light.
    Your own V5C hasn't arrived in about a month from the sale.

    How old, what price, what mileage?

    Yes, send a V62 plus £25 to DVLA to request a V5C, but I'd not necessarily be worrying just yet. How have you taxed it, though, or are you keeping it off the road?

    It has been driven as previous owner said she never cancelled the tax, she sent me a v5c/2 today in post with a letter saying the car was sold as seen but can I tax the car with this if it was a cherished plate

    You bought the car without the plate being included in the sale.

    Does that V5C/2 have the old plate (the vanity plate), or the correct plate on it? If it's the old plate, and you try to tax it after the plate change has gone through, but while it's all in the post, then the doc ref won't work, because it'll be for a previous V5C. If the plate change hasn't gone through yet, then you may find that the tax gets applied to the wrong vehicle, gets sent to the old keeper, or the plate gets incorrectly sent to you. That would NOT make you the legal owner of the plate, though...

    When she gets the V5C with the correct plate on it, she needs to fill that in and send it back to DVLA with the date of the sale on it. She'd be a fool if she put anything but the ACTUAL date of the sale down.

    This is all one of the many reasons why people should sort plate transfers out BEFORE selling, and not buy a car without the correct V5C.

    When she notifies the DVLA that she no longer owns the car, the tax is automatically cancelled by the DVLA and it is up to you are new owner to tax the car.

    You can check the current tax status by putting the registration plate and make into the DVLA website.

    How have you insured the car, which plate have you used.

    She has not notified dvla of change of ownership yet & has sent me the V5C/2 of the cherished plate which is no good to me as I would need the mot cert she sent to Swansea to have the changeover done. So now I have a car which i am not the registered owner of & cannot tax because this woman dosnt know what she is doing to change the cherished plate. The car is currently insured on the cherished plate by me but I have told the insurance that I am waiting for the plate to be changed by previous owner

    What do you need the MOT 'certificate' for?

    It's not a certificate it's simply a piece of paper - the real MOT is on the data base at DVLA.

    If and when the registration plate is changed they don't issue an updated MOT bit of paper any more.

    Sounds like you need to go back to the seller and instruct her how to do the paperwork properly.

    I am well aware that I bought the car without a V5C but I took it that this lady was as honest as I was but obviously she is as honest as you are helpful

    Sorry, why are you throwing accusations of dishonesty about?

    You chose to buy the car in the full knowledge that there was no V5C available. You were told that as soon as the V5C with the correct registration is returned from DVLA, the keeper change will go through.

    Are you suggesting that you know that it has definitely come back, and she's deliberately not doing that for some reason? Pause, think, and ask what possible benefit there is for her. Right now, you're driving around in a car for which she's still paying tax, and she is the one who is going to receive any NIPs that come through. All the risk over the delayed keeper change is hers.
