The Comedy of Errors continues ...
  • Woah thanks for the replies people!! Yeah it is the estate next to Treliske! We're moving out soon because the parking is terrible and we used it as a stop over to look for somewhere else.

1 ticket was given when I used a temporary visitor pass for over a week, apparently I went over the allocated time slot for a visitor to be visiting. It was a new company vehicle while I was trying to find somewhere for my car. We're only allowed 2 cars per house hold. We have a garage but theres gym stuff in there. We do have a pass but only 1, as we have a garage we cannot get another one so I have to leave my car at work in the week when I'm using the company van.

Another ticket was give purely because I didn't get home in time to update said visitor pass for the van.

Another was given because my ticket had fallen off down between the window and dash board and I couldn't get to it

Another ticket was given, wait for it, while I went inside while washing my car to clean my bucket. front door was open and window wipers were poking up, suds all over the floor, they knew what they were doing.

I have paid another 2/3 tickets off right away since living here too.

Friends came down and got one while they were filling in the visitor form 10 mins after they arrived.

Just getting a little sick of their face to be honest.

I will post another reply with emails from them

    Thanks you sexy bunch!

  • Dear Sir

    Thank you for your email.

Please be aware that at the time you contacted us yesterday (26/04/16) regarding Parking Charge Notices (PCNs) 925973 and 926115 are out of the early repayment period.

PCN 925973 was issued on 3rd April 2016 which was 23 days old at the point you contacted us yesterday.

PCN 926115 was issued 10th April 2016 which was 16 days old at the point you contacted us yesterday.

The early repayment discount period is only valid for 14 days from the date the PCN is issued, therefore both PCNs were out of the discounted rate period and the instalment plan has been correctly addressed.

    Kind Regards

    Armtrac Security Services

  • Dear Sir

Thank you for your letter of appeal against Parking Charge Notice (PCN) 921732 issued by us to you on 11th August 2015 at The Spires Private Parking, Truro. Having carefully considered the evidence provided by you we have decided to reject your appeal for the following reasons. This appeal is now closed and our decision is final.

When parking on private land, a motorist freely enters into an agreement to abide by the terms and conditions of parking in return for authority to park. We have many warning signs located in the car park, including one at the entrance informing drivers parking restrictions are in place. If you read our warning Signs they will tell you that this is private land and by parking or remaining on this land, you or the driver accept liability to pay the parking charge of £100.00 for any failure to comply with the terms and conditions as stated on the signage.

Permission to park here is by means of displaying a permit, you did not do this, therefore you were legitimately issued with a Parking Charge Notice. Our photographic evidence (which you can view online at #XXXXXX show that your vehicle was not displaying a valid permit. Our instructions are to issue a PCN to any vehicle not displaying a valid identifying permit. The PCN was legitimately issued for 'No Permit'.

Our warning signs clearly state Private Land PERMIT HOLDERS ONLY at the entrance to the site and TERMS AND CONDITIONS: VEHICLES MUST FULLY DISPLAY A VALID PARKING PERMIT IN THE FRONT WINDSCREEN OF THE VEHICLE, therefore we have made members of the public fully aware of what the site rules of parking are, including the requirement that a valid authorising permit must be displayed at all times whilst parked on the site.

Our Warning Signs clearly inform members of the public what the charge will be if they are to breach the rules of parking, these signs clearly state PARKING CHARGE OF £100 PAYABLE WITHIN 28 DAYS OF ISSUE and RETROSPECTIVE AUTHORITY TO PARK WILL NOT BE ACCEPTED. BY PARKING OR REMAINING ON THIS LAND, YOU THE DRIVER ACCEPT LIABILITY TO PAY THE PARKING CHARGE FOR ANY FAILURE TO COMPLY WITH THE TERMS AND CONDITIONS CONTAINED WITHIN THIS SIGN.

We have approximately 300 sites and it is not always the same Patrol Officer covering a particular site and they cannot be expected to remember every vehicle that parks on a particular site, therefore the only way our Patrol Officers know that a vehicle is authorised to park is by them displaying the valid Permit.

Armtrac Security Services are not the landowner, we have been contracted by the landowner to ensure the clearly displayed site rules of parking are being adhered to. As this site is clearly signed that it is Private Permit Only Parking the landowner has requested that any vehicles left on the site be issued with a PCN, landowner's have the right to set the rules of parking on their land and the right to enforce those rules. Armtrac Security Services have a duty of care to the landowner to ensure their terms and conditions of parking are being adhered to and not being abused. Drivers have a duty of care to ensure that they abide by the clearly displayed terms and conditions of parking within the site. The landowner at this site has stated that all vehicles that are permitted to park on this site will have already obtained a valid permit from the landowner/managing agents and have it prominently displayed within the windscreen of the vehicle at all times. We have checked our system records and we received no notification of any vehicles parked on this site without displaying a valid authorising permit on 11th August 2015.

With regards to your comments regarding parking on the site and the parking permits. As Armtrac Security Services are not the landowner we have no authority over the parking offered at this site, as already stated we have been contracted by the landowner to patrol the site and issue a PCN to any vehicle parked in contravention of the clearly displayed terms and conditions of parking. The landowner for this site has informed Armtrac Security Services that all letting agents/estate agents/managing agents that deal with properties on this site have been made fully aware of the site terms and conditions of parking, including the fact that ALL vehicles MUST display a valid authorising permit whilst parked on this site. All permits need to be requested through the letting agent/estate agent/managing agent you have rented/brought the property off, however if you do still require a permit please email into us requesting this and we will forward this onto the landowner for you.

Whilst we sympathise with your circumstances we cannot take mitigating circumstances into consideration, the rules of parking are clearly stated on the warning signs. The landowner has set the rules of parking and employed Armtrac Security Services to ensure the rules of parking are adhered to.

The fact remains that your vehicle was parked in contravention of the clearly displayed site rules of parking by not displaying a valid authorising permit and the PCN was legitimately issued.

You now have 3 options from which to choose-

    1. Pay the Parking Charge Notice of £60.00 within 14 days, after which time the discounted rate will no longer apply and the Parking Charge Notice will rise to £100.00.

    1. Make an appeal to the IAS, if you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). In order to appeal, you will need your parking charge number, your vehicle registration and the date the charge was originally issued. Appeals must be submitted to the IAS within 21 days of the date of this letter. Please visit XXXXX for full details. Please note that if you wish to appeal to the IAS you will lose the right to pay the charge at the discounted rate of £60.00 and should the IAS's decision not go in favour you will be required to pay the full amount of £100.00.

    1. If you choose to do nothing and the Parking Charge Notice remains unpaid after 35 days the matter may be passed onto other hands for collection.

You can send a cheque payable to Armtrac Security Services and please send it to Armtrac Security Services, PO Box 154, Penzance, TR20 9WD. You can pay online 24/7 ator alternatively you can phone the office Monday to Friday 9am – 5pm on 0871 2000 476.

  • Sorry admin if this is considered spamming please delete. I got the last email as one of my first appeal rejections and non of the pictures they sent me actually had my car in. I'm a bit of a hippy so I'd always just thought I was paying the price for my own mistakes, it was only when a neighbour was talking about it he told me to ignore them.

Thanks for putting up the emails. I'm particularly interested in any evidence on this company as Im local. STOP paying them and ask them to send a copy of their credit licence. Tell them if they fail to do so you will report them. I don't know the rules re: offering payment deals and private companies but if they need a licence then KBT wont have one.

They have been to court at this location see this thread on pepipoo http://forums.pepipoo.com/index.php?showtopic=82451&st=0. They did win but they pulled a dirty one and the poster was not as prepared as they should have been. This was for parking on the road not in a parking space. This was also one of the last times this company are known to have attended court. I post on pepipoo as farmerboy.

Their standard contracts only allows them to pursue drivers for trespass. This means limited costs to you if you lose and it all goes to the landowner not KBT (armtrac) Any attempt to persuade you you've entered into a contractual agreement by not displaying your permits is nonsense.
Theyre treating you like a mug, Why are you putting up with it.

Sorry to burst anyone's bubble but collecting your own debts and extending an installment plan without interest repayable within 12 months is NOT a regulated activity. It used to be under the old system but not any longer (had to be repaid within 4 months) and in any event it is not a debt due under a regulated credit agreement or a consumer hire agreement. Armtrac do not need a credit licence to offer this facility.

Didn't think I would ever come to Armtrac's defence but I'm not really just trying to make sure someone doesn't stub their toes and wastes an inordinate amount of energy going nowhere.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
