Prize delivered to wrong address

    My take on it is that the prize is long gone or in use...

    Send the letter by all means but there is no point following through as it would be a straight financial loss.

    I doubt the recipient still has it tbh.

    Time to move on.

    From the first post they have admitted it is in their possession
    I then received a really rude text from the people at my old house, informing me that they would not allow me to collect the parcel as they were going to contact the company to come and collect it (they had had the parcel for ten days at this point

    I disagree and hope the person follows it through ALL THE WAY. Do not give up! I would also file a complaint to the police about them not helping you.

    I don't think there will be a positive outcome to this, a lot of time has already been wasted - and no doubt aggro too - last time I moved house I resigned myself to maybe missing out on a prize or two after I left. NOT leaving a forwarding address was a more important factor at the time (don't ask!) and anything important had long since been diverted to my parents address.

    In my experience the police are the last people to seek reliable legal advice from. You would stand more chance of help on a relevant internet forum.

    I'm a bit confused as to why you involved your former landlord? What could they possibly do?

    My take on it is that the prize is long gone or in use. I suspect the person who took it would think twice about it next time but probably thought as is common in rented property that the previous tenant would have no reason to ever return.

    I completely disagree with you on this! If the prize had got lost in the post due to moving home then maybe forget about it and move on! This prize is not lost though - The OP knows exactly where it is and who has it (Or who had it!). There's a matter of principle here and the person that took delivery of this should not get away with it! Having said that, I'm not sure you will get the item back as they have probably sold it or are using it (Which is why they are reluctant to give it back) but even so you should still put up a fight for it!! Make the thieving 'you know whats' sweat! Good luck with this - I really hope you get some sort of resolution :)

    Did you let your old landlord know? He has a right to know if he has a thieving tenant.After all it is his house and the parcel was delivered to his house and stolen/took by the person in his house.

    I'd want to know if it was my tenant.

    I think you're right, I don't think we'll get it. As I said before, something just snapped and the rude and aggressive tone of her texts made me,so cross. The last one spike volumes where she basically said why should the police waste their time on something that I got "for free". In other words, I didn't pay for it so she has as much right to it as I do!!

    Not sure why you think I've involved the landlord, I've had no contact with them at all.

    I completely agree. If my husband hadn't been forewarned that they were likely to try and fob us off, I would have given up. It's not on that people aren't given a truthful assessment of the case because of cutbacks. I know the police are overstretched, and I don't expect this to be a priority case (!) but I do expect a potentially criminal offence to be treated as such. I suppose my message would be, expect them to try to give you the brush off and don't stand for it!

    What I would do.

    Letter before action sent to the address. Giving them 14 days to make contact and arrange a suitable time for collection. Making it perfectly clear that should this not happen then a claim will be made against them in the small claims court.

    I've sent a letter before action for another issue and whilst i didn't reclaim all the money i was hoping to, i got an amount i was satisfied with.

    When sending the letter before action, make sure you send it recorded delivery.

    Just playing devils advocate here, but you might not get anywhere with small claims court as you have not actually suffered any financial loss. I might be wrong but you have not suffered any loss as such as the item was a free prize.

    You might want to check before you pay out for the small claims fees.

    Those posters advising you to forget it and move on are probably giving the best advice here to be honest!

    So if someone say won a car and it was was stolen/delivered to the wrong address there would be no legal recovery because it cost them nothing in the first place?

    Quite possibly but I would suspect that something more high profile like this would be dealt with differently.

    The only way the OP will know is to take it through a small claim and come back to let us know the result.

    I don't think the police will take it any further as its really not worth their time - whereas a car might be.
