chris0147, have you literally not heard a thing from them or anyone else re: the PCN since?

No I haven't heard anything from them since they have put the PCN on my windscreen. Is there a good reason that you should be worry about?

No-one needs to worry about debt collector letter chains about private parking charges, just open each letter to make sure it's not a change of tactic to actual court papers or a Letter before Claim, which cannot come from a debt collector.

All the time it's these threatograms it is fine to file them. You will get more every second month or so.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So forward fast from the last correspondence from CSB solicitors, we have not heard anything until yesterday, when a letter from the parking company, Ultimate Customer Solutions have sent another letter.

The letter (sorry havent got a scanner at home so here's the body of the letter) says :

    "Dear Mr .................

    Principal Balance Due : £100

    Administration Fee: (inc VAT) £60

    Total amount due £160

You have recently been written to regarding the above debt

As this matter has not been resolved, we have referred the matter to the creditor to consider the matter for legal action.

Before commencing such action, I have been instructed to give you on final opportunity to settle this matter so that he can demonstrate to the court, if necessary, that every effort has been made to settle this matter without the need for court proceedings.

The creditor has advised that he is prepared to accept a reduced sum of 70% of the amount due shown above in full & final settlement providing payment is made in the next 14 days.

To take advantage of this offer make your payment online at https://www.contactucs.com or use an alternative payment method found on the reverse of this letter"

So back in May London Parking Solutions Ltd/Utimate Customer Parking send the fine onto CSB solicitors to deal with because we didnt pay, and the solicitors added on fees onto the £160 (and demanded £202.25) now its gone back down to £160 and back to the company and they are prepared to accept a reduced figure to settle.

So can i assume this is them clutching at straws to try and get some money out of us?

Surely this cant be classed at Letter Before Action, could it?

Anyone else had one of these letters?

Seems like desperation, if they were certain they would win, they would not reduce by 70%.

Looking back through this thread, it seems they did not follow the correct procedure and they probably know that

CSB Solicitors are Ultimate Customer Solutions so a right load of old baloney going on there.

Yes it's just another desperate debt collector attempt to get you to cave in and pay annything they can get out of you, it can't be an LBA as they can't take any action.

I hope you've complained to the SRA about both letters for being misleading.
In the first one it mentions a warrant fee that doesn't exist, the 2nd mentions £60 in legal fees when they can only charge £50. Both are trying to imply that legal action is coming, when it can't be (since the can only act on behalf of LPS). Both are also trying to claim charges that don't exist (which is why the number has gone down) - they work on comission.

In addition to that they are both debt collecting letters pretending to be solicitors letters and are clearly intended to be intimidating whilst mis-stating the facts.

Don't bother replying directly to them - there's nothing to be gained by communicating with debt collectors.

To be truthful havent complained to anybody, but yes they are both misleading arent they!

Didnt know about the discrepancy between the £50 and £60 but that just sums it all up doesnt it!

Absolute load of baloney, what legitimate company would offer a reduced fee to settl, if a sum is legally payable why would anyway offer to settle for reduced amounts!

It has made me feel so much better getting the responses on here though, sadly though how many people just cough up and pay the fines!!

Please reconsider and make the complaints to BPA + SRA + CSB - the more that they get the more likely they are to take action which will benefit all who are yet to follow you.

You speak highly of the help this forum gives you.

Indeed this free advice forum seems to do far better than the paid for appealers from the grumbles we get here from their disgruntled customers.

So you would be helping the cause (at no cost to you) and of great benefit if you would do the complaints!
