also on the photograph the number plate must cover aproximately 1/3rd of the overall area of the photo, If not, photo is not of evidential quality and as such is inadmissablein a court of law. Request the photo and see what the quality of the photo is. Also is your speedometer accurate? ie would you have known that you were travelling at 38mph? was it a police car or camera that caught you? Different procedures for each. Was the road speed clearly marked at regular intervals or could you easily have believed that you were travelling at the correct speed at the time?
I'd try doing some google searches for the different regulations under the road traffic act 1988 and similar.
good luck. (from an ex traffic cop.)

I work within the criminal justice system and what i would do is let it get to court where the magistrates will allow you to give your side of the story, of cause stating that it couldnt have been you/camera is faulty etc, plead your innocence and provided you have a bunch of soft magistrates you will walk out if on the other hand you get a district judge he may well give you a harder time, but a lot of cases do get thrown out of court due to the prosecutor not having correct/legal paperwork.

Best just to get it paid. If they take you to court it's likely you'll get found guilty and fined £250.

Its your fault-why did you legally register the car so you could be traced? next time do what the cowboys do and get away with it.
Seriously can someone say why virtually no effort is made to trace unregistered drivers-this llphole has been used since vehicles have been on the roads.
Same old thing-get the drivers who are legal in the first place!

hear hear roddy, sadly it is nigh on impossible to catch unregistered drivers unless they are caught on ANPR cameras (automatic number plate readers) which many forces are now introducing for roadside stop checks. If they go through a normal speed camera there is very little that can be done to capture them.
I agree, law abiding motorists are the easiest targets, but then if ou don't go above the speed limit- no problem!! (if only it were that easy hey.)

I got a letter the other week from them saying I had been caught.
I wouldnt mind I had only had my car 10 days and driven all the way to Angelsey and back only to get caught round the corner from where I live!!!
Been driving for 25 years never had a ticket before!:A
• I'm sorry but it really gets me how people try to get out of speeding tickets... you were speeding, you got caught.. it really is as simple as that! The speed limits are there for a reason so if you don't want a £60 fine and 3 points don't speed. Simple as that.

For the record I have 3 points on my licence for doing 47 in a 30 at temporary roadworks on what's normally a 70 road. I paid up learnt my lesson and now don't speed.

I have to say I 100% agree (and I also have 3 points for doing 36mph in a 30)

Bummer really BUT if you are prepared to go above the limit you must be prepared to take the consequences if caught.

I'm sure that the appeals process is in place for genine appeals and not just people wanting to get out of paying/points. If you know you were speeding and go down this route IMO you are abusing the system which in turn makes it even harder for genuine appeals.

MSE is about saving money not getting out of fines that are *bang to rights*

• Are they having a speed testing spree this month or something?

I too got a notification, for doing 36 in a 30 mph zone near where I live. My first ever offence, and I could kick myself - I am usually very good at sticking to speed limits, but I was just returning from my brothers funeral so was not really thinking about the road. My fault, my speeding, so I have to pay the fine.

Been a !!!! few weeks anyway - can't say it made me feel any better to receive a speeding ticket though!
