Asda Smartparking charge. Help please.

I have received a £40 fine for overstaying by 20 minutes at my local Asda. Don't have receipts still. Went for a meal. On returning and leaving it seems I'd gone over the "3 hours" limit. What is the best route to follow, please? Should I just pay up?

have you been back into Asda to complain to the manager? ... not the customer service ...... oh and do not accept the ' we do not own the car park so cannot help' its a cop-out and wrong ....

It is not a fine, it is a speculative invoice.
Do not think of paying this bunch of scammers.
As above, read the Sticky thread for NEWBIES then appeal using the BPA template in blue.
In addition, complain to the CEO and/or manager of ASDA telling them you and your family will become ex customers if this isn't cancelled. If you have receipts or bank statements from previous visits, use those to show you are regular customers

I've been reading around quite a lot on this since posting, using other forums. It seems I have roughly an 80% chance of winning and having the charge removed. But these days it seems there is a 20% chance I'll lose and end up paying substantially more. It looks like too much of a gamble for me, to be honest.0

You have 100% chance of winning against Smart Parking (never seen one lost using our advice).
You would be MAD not to follow our process; look how simple it was for this latest lady, cancelled at the first attempt:

Smart are one of those PPCs who actually cancel straight away when they see the template appeal, from a registered keeper. The point being, Smart cannot hold a registered keeper liable because they do not use the POFA wording in their PCN.
So as long as no driver is admitted, you win by appealing as keeper, saying they will have to rely on the POFA or cancel. One of the very easiest firms to beat.
And as for paying 'substantially more' = nope, that doesn't happen with Smart Parking. Even if someone appeals badly as driver and then mucks up POPLA (which we would not because Smart are easy to set out a keeper appeal against) then they are only asked to pay the full PCN. Not 'substantially more' and they do not have to pay because POPLA is not binding and Smart don't sue people.
But that's only going to happen if you appeal as driver. Don't write about what happened, use the template appeal in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It wasn't in Asda, but in the Marina complex attached. It is the only place on the complex where our particular vehicle can be parked. I can't explain more without giving clues to who I am to the parking company if they read this.0

ok , if this was a marina complex , what has it to do with asda?
did you park on asdas separate carpark clearly marked as being patrolled by THIER car park management and eat off the site?
or is the whole complex (marina) overlooked by the same company that patrol asda?

Yes, it's definitely ASDA's own car park and tripped their cameras; it's part of the wider Brighton marina complex.0
