Pre-nups have no validity in English law. Bad luck

That's not strictly correct. Pre-nups are not legally *enforceable* in English Law, a pre-nup is, however, one of the relevant factors which a court will take into account, in determining what is 'fair and reasonable' as a settlement.

Generally, a court will say it is fair to to follow the terms of the agreement in a short marriage, provided that:
    - the agreement met all the appropriate criteria when it was set up (e.g. both parties having legal advice, full disclosure etc)
    - there have been no significant / unexpected changes (such as the birth of a child)

However, the longer parties have been married for, the less weight is likely to be given to a pre-nup.

English divorce law doesn't generally seek to punish a 'guilty' party so the affair is unlikely to be relevant. (and it is improbable that any provision in a pre-nup relating to infidelity would be followed by a Court in this country)

If the sports car was a gift to the husband then he will probably be entitled to keep it, dependent on the rest of the settlement.

Of course, all this depends whet the pre-nup actually says, and when it was signed.
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)

If a husband signed a prenup before he married his wealthier wife then they divorced after she had a lengthy affair would she still keep hold of all her assets including the sports car she purchased for him?

You remind me of one of those babies who eats a chocolate ice cream but most of it ends up on their face.

OP, if this is the fall-out from your sordid affair with your boss, then I hope the husband (and the 7 year old son) get considerably more than a sports car.

Op she will probably treat you like she treated him once she gets bored!
  • @RuthnJasper It was not a sordid affair. He was a bad husband who quit his job to sponge from her. All he did was sit on his fat !!! playing video games. She wanted more from a man and I gave her more. Can you blame a woman for wanting a real man?

Thanks to the real expert's for the sound advice.

Whether male or female I don't think it matters. If I was the wealthier partner and my partner decided to quit work completely and "sponge" off me then I would be cutting off supply. That would soon get the non-working partner thinking about going out and earning some money for themselves.

All of the partners I've ever had (I'm male and my partners have been female) have been very independent refusing to be supported by myself even in sometimes desperate times of need. That to me is a real woman. Someone who can either tighten or allow to be tightened the purse strings enough to make ends meet without complaint and also without suggesting that I liquidate my investments held in my name to get some liquid capital to meet a shortfall. I would rather live on beans on toast than sell the house. A shortfall is never going to last forever. With extra effort I can increase my income. She can also increase her income and we'll be back to normal. If she refused to help out when she is capable that's when I would have to cut off the supply of luxuries. No more video games (she does play games on the tablet), no more mobile phone payments (although at only £5/month I would keep that up..but no new phone), no alcohol (she does understand that must stop -for both of us- if we are ever short of money). I'm sure most people would think like this. Yes it is our money but spending more than we earn is not possible so therefore either income has to increase or expenditure has to be cut.

:p Regular savers earn 6% interest (HSBC, First Direct, M&S) :p Loans cost 2.9% per year (Nationwide) = FREE money. :p

Then she should have deal with that issue instead of jumping into bed with a work colleague - which resulted in both you and her being suspended by your employers.
