Parcel was stolen - what do?

    Make sure you have a copy of this on an official police letter head and that is is dated and stamped by the investigating officer and includes his badge number.

    You will lose the Ebay case as it shows a delivered - for your appeal you will need the above.

    Yes, i did not win, got a email saying the usual generic eBay stuff "We will not be issuing a refund at this time as a resolution was reached".

    No resolution was reached, the seller could have made it real easy and gave eBay the correct tracking info that is was delivered to wrong address, instead they wrote "Package was delivered signed for" nothing else, no details, nothing, i hate lazy responses.!!

    I appealed today, at first eBay told me to take it up with FedEx - so i asked FedEx for the details and they refused, saying they could only give it to the seller.

    So.... contacted eBay again and told them this, now they say they will contact the seller requesting tracking and delivery information from FedEx.

    It goes on.....

    Well, you may have some luck. In instances such as this if the seller cannot provide tracking showing delivery to the correct address, ebay could reverse the result or they may refund from their own pockets.

    I hope so, i will update anyway whatever happens.

    If it fails i will go to small claims court and get FedEx to release the info to the courts somehow.

    One thing is for sure, i will not buy from that seller again and leave them negatives on completion.

    You need to submit as much evidence as possible to refute the claim, if you bamboozle eBay enough they tend to think you are serious and settle, although that's no guarantee. Upload, quantify and stand firm on the non delivery to YOUR address.

    Your seller is contacting Fedex and is trying to sort this out, despite a claim being opened. It seems to me the seller is as much a victim as you are. You can't blame him for the failings of a carrier.

    If you leave a neg the seller is very likely to stop trying to resolve the problem.

    To be honest if I were the seller, I protect my account first, but I do let the customer know I will make a claim against the carrier by disputing the delivery. In an instance where the item is clearly not with the buyer but at another address, I would have no hesitation in refunding/replacing, but I would allow the case to go in my favour to protect the account status.

    It seems this seller could have made more attempt at communicating what his intentions were. I always let my customers know that the case resolution isn't the end of it if they are disputing the carriers status.

    You are spot on. The seller was advised by FedEx to make a claim for a lost/stolen parcel, but they have not refunded me, nor advised me, nor have they told eBay anything. When i told resolutions the seller was advised by FedEx to make a claim for lost or stolen parcel he said he would message the seller immediately and ask for confirmation from FedEx.

    This is a bad seller, deserves a negative, i won't be the first to neg them either.

    From a sellers perspective, delivery shows as confirmed.

    You need to allow them time to file a claim with Fedex and for Fedex to investigate and respond. It's not reasonable to expect them to refund on your say-so, because otherwise what's the point of tracking.

    Perhaps the seller is not as responsive as you like, and the feedback you leave is up to you.
