Tenant ignoring all contact from Letting Agent

    How do you know this tenant won't stay long term? Perhaps going periodic gives them some peace of mind that they can leave when they want. Also they may object to paying the agent's fee for reprinting the contract!

    Because none of the previous tenants have :)


    I'm sure that's all to do with them though, and not the common denominator.... :)

    In the circumstances I'd advise your tenant to stop paying rent the moment your S21 arrives and to drag out leaving for as long as possible, just to teach you a lesson in how to be a landlord. If you wanted a long term tenant why didn't you set up a term longer than 6 months in the first place?

    I understand the OPs position.
    I went round to check up on my previous tenants and saw they had left the toilet seat up. Suffice to say they were immediately served an s.21.

    As I understand it this situation couldn't happen in Scotland given the recent changes, we can only hope people in the rest of the UK are given the same protections soon.
  • In most jobs, being as thick as mince (basic literacy, looking up "the law" on Google, unable to calculate basic risks/returns etc) would get you fired. And yet anyone can be a LL and have control over people's home security. Depressing.

    While I appreciate she would have had rental liability until her notice expired, Council Tax can only be charged where there is a ‘material interest’ and this is defined as having ownership of the property or being bound by a minimum of a 6 month tenancy.

    To be fair, the wording is quite misleading and, read on its own, the sentence is in fact incorrect.

    I think he probably will come back and have a rant about how he didn't come here to be abused etc etc.
    Poor tenant, I hope her next Landlord has more sense.

    Tenants only pay council tax for a property they are living in. The landlord pays it when it is empty and may qualify for a reduction in the rate for a period in such circumstances, depending on an individual council's policy. As a landlord with a potential liability for the CT on any rental property you own, you should know that. The paragraph quoted needs careful reading, but is perfectly clear.

    So the tenant is ignoring the agent ( which is fair enough).
    So you can either accept the periodic tenancy or serve notice and start things in motion with the aim of eviction.
    That's your choices.
