Tenant ignoring all contact from Letting Agent

    Right just rang the council and they said if the tenant is on a periodic tenancy, they are responsible until they leave, so even if the periodic tenancy is for another month, and they leave after 2 weeks, they are only liable for the 2 weeks not the full month.

    Seems a bit unfair, that's why I wanted a fixed 6 month contract, at least that way there is a bit of security, anyway will look into giving her the 2 months notice, and look for someone else.

    I think you need to calm down and apply some rationale...

    If you can't afford to 'risk' a few months council tax you are in the wrong game...

    The only drama queen is you. Having a tizz because someone won't sign up to a contract. It'll take you another two months at least to evict her, I hope you get a void. You deserve it!

    Council tax is - let's estimate £140 a month


    Letting agent fees - £300-400 (at the lower end)


    Void Period - Let's say it's a month so £600 (?)


    A small chance of rent not being paid by the new tenant


    Actual eviction costs for new tenant if rent isn't paid, or if they don't renew but decide they want to be 'homeless' - £300


    All just in case a tenant doesn't pay their council tax - seriously who gives these people mortgages?!

    Same landlord a few months down the line...

    "I want to kick out the tenant/put up the rent/get vacant possession in the middle of a six-month contract, what do I do?"

    I have been renting for the last few years to various tenants, I have never had any issues, with non-payment of rent or anything else. My letting agent has always taken care of everything, that's what I pay hi for.

    I am just looking for someone longer terms, a periodic tenancy gives no long term security to the landlord it seems, and to be fair my property is in demand, I have got a previous tenant who has contacted me to show interest, so not really worried about dodgy tenants or anything like that.
    Do you have any reason to believe your current tenant is going to do a runner or stop paying her rent? If not, why evict her? Even a tenant on a six month contract could stop paying.
    And do you really want to have to pay extra fee's to the agency to re-let the property?

    1: you are wanting to make someone homeless because they wont do as you want.
    2: You haven't had those issues yet. No landlord gets to the 5th tenant and says. oh well this one wont be paying their rent. Circumstances change!
    3: You want someone longer term, but have rented to 'various tenants' over the last few years, so that suggests 2 more on top of the current one. So how long to these tenants stay? Ask yourself why they aren't staying longer!
    4: Your magic letting agent who cant give you basic advice on council tax....
    5: Your previous tenant will no doubt wait the 3-5 months it takes to evict someone...
  • You've spoken about the risk you'll have to pay a few weeks council tax if she gave you notice, and then left partway through that notice period. However, she'd then be paying double rent, so I imagine she'd try to avoid or minimise that overlap.

    On the other hand, if you ask her to leave, you'll have to pay fees to the agency for the new tenancy to be set up, and you may have a gap between tenants, which could well cost you more!

    Round here, a month's council tax is less than the cost of 3 days gap between tenants, let alone the agency fees.

    As a landlord I much prefer periodic tenancies: More flexibility for landlord to evict - if necessary, never needed to go to court - and more incentive for tenant to adhere to tenancy terms, more flexibility for tenant to leave at shorter notice... I tell tenants they can stay as long as they like as long as they are happy & I am happy, and if asked say I am happy if rent paid in full-on.time, neighbours happy, tenancy terms respected, place looked after.

    I've never understood why so many landlords want renewals signed.. .. we know why agents want them..

    Dear Dr, what exactly is it you think you gain by a signed renewal??

    How do you know this tenant won't stay long term? Perhaps going periodic gives them some peace of mind that they can leave when they want. Also they may object to paying the agent's fee for reprinting the contract!
