Flannels (refund )

Hi just wondering if anyone can help me my son bought a t.shirt from flannels just over a week ago to wear tonight he paid £105 for it when he put it on to show me it's awful so I told him I didn't like it and was not worth £105 so I told him to take it back and get a different one but he didn't like any of them in the shop and were nicer online so I told him to get a refund and go and either put it in his bank and order one offline or go and get a different one from another shop, so he rung the shop yesterday to ask if he can take it back for a refund to be told NO we only exchange or credit note I'm absolutely fuming over this £105 for at shirt and they don't refund I have been on the website and it says that if bought online they DO refund how is this possible there Internet site gives refunds but there stores don't ?

    Different consumer legislation. There is no right to return an item for change of mind when bought face to face. The fact that they are willing to exchange or give credit note goes further than the law says they have to.

    Online purchases are covered by the various distance selling regulations.

    The reason for the difference is that you do not have an opportunity to inspect the goods before buying when bought online.

    You can get a refund if faulty but I don't think 'Mum/Dad thinks its awful and not worth the price' is a valid reason

    Two things. Firstly, I'd also be fuming if my son bought a t shirt for £105 :eek:

    Secondly, your son has no legal right to a refund for a simple change of mind purchase. The reason that he can get one if purchased online is because different rules apply to "distance sales" because, for obvious reasons, the purchaser isn't in a position to fully inspect the item they're purchasing until after they've received it.

    Probably not, your son saw it in the shop, liked it and bought it - unfortunately the time for him to change his mind was before he paid for it not after taking it home.

    Although they don't have to, the store may be able to order a tshirt instore for him if he asks very nicely.

    But he didn't change his mind, his mum/dad did it for him ;)

    What does your son think of the t shirt? There's an awful lot of 'I' in this story.

    No big deal assuming it's his own money-now he can take the credit note and get something that's less of a rip off
