paid my builder with credit card

    I am starting to wonder if this problem is real.
    The poster posted about getting a refund of a five year old ikea matress because he had a sore back.
    The Lithuanian friend, the rats, and the building threads from 2015 make me suspect the same! :D

    It is a very complex case and you need to see a lawyer not a internet forum.

    This is incorrect. The total of the contract was way in excess of £30k.

    The first question any card issuer will ask is "how much was the total cost of the build ?"

    That would be the end of the Section 75 conversation. No need to see any lawyers, there is no cover.

    There are a lot of trolls on this forum(and indeed the internet) this is no doubt one of them.


    They deliberately post controversial threads then argue with those who feed the troll to keep it alive.

    So he posts months ago about whether or not he could pay £150k bill using 5 different CC's for £100 to get protection 'just in case'

    And lo and behold would you believe it the deal went bad. What foresight.

    Good luck with that claim. Its ok though i hear that uk prisons are like holiday camps.

    I wish I had email notifications whenever I get replies on this thread.

    Wow there are some easily agitated people on here, calling me a troll and a criminal. Thanks to the others who remained a bit more pleasant.....

    Anyway, I have spoken to the financial ombudsmen and I have been informed that in these circumstances I would be covered.

    To confirm, my build costs £150k. I split the build into several steps, with the builder issuing me with invoices and receipts for each step. By paying for each step with my credit card, I am covered by s75. So eg:

    step 1- foundations- cost £30k, pay on CC £101. Invoice and receipt issued.

    Step 2- walls and roof- cost £30k, pay on CC £101. Invoice and receipt issued.

    step 3- internal fixings- cost £30k, pay on CC £101. Invoice and receipt issued.

    etc

    I hope this makes better sense.

    You've spoken to a telephone advisor at the FOS, not someone who would make the decision as to whether s75 should have applied.

    It is normal practice to make staged payments for building work. However, your contract with the builder was for £150k, not for multiples of £30k.

    If I was your cc issuer, I would find it very difficult to believe that your foundations, walls/roof, and internal fixings all cost exactly £30k each.

    The solution to your problem is simple - if you believe you're covered, make your s75 claims and when rejected, take your complaint to the FOS (particularly since they've already confirmed that you would be successful).

    This is probably the right answer, however theoretically there could be 5 contracts (or maybe 6) each for less than 30k.

    If this were the case then the OP's story still falls apart because the same card could be used for each and there would be no need to use 5 different cards.

    Also presumably each contract would have to be fulfilled before work started on the next so only one claim could be made, and if work to date was unsatisfactory I would find it difficult to believe that the builder would be engaged for further work

    The FOS haven't made a ruling on it.

    In my opinion what they've told you is utter nonsense.

    Pursue your complaints. But don't raise your expectations too high.
