Sold a house with a dangerous boiler! Where do I stand legally?

I've never taken legal advice from an engineer. Novel idea...
The suggestion is you buy a new boiler. Highly useful advice.
A gas engineer who does certificates would by extension know something about the legal implications around property and gas maintenance. Turns out if the sellers lied on the paperwork then he may be correct. Its really not that bizarre.
Ah but like my mother said - it's not what you say it's how you say it.
Instead of over sensitive I'd say I'm the kind of person who instead of ignoring ignorant remarks I like to challenge people. Arguing on the internet is futile but I'm not a cupcake who will ignore comments without giving some back.
Anyway. I've always said I'm aware it's buyer beware (unless there's been misrepresentation) so I really don't get the need to be sarcastic. I'm not on here insisting I would definitely get compo and I haven't started from that assumption at all. I think people posted just to make themselves look clever.
Will repost once I've checked paperwork.
And thank you again to those who spent the time explaining the nuances of how it works to me.0 -

I am really sorry for your troubles ladymagpie, and it is indeed frustrating to move into a property and suddenly find 1000s of pounds needs spending on it. Happens a LOT though. Some people wait until everything is on the verge of packing up in their house, and stuff needs replacing/repairing, and then sell it.
I'm afraid there really is very little you can do if the boiler is no good. However, if someone said they were a CORGI registered fitter and they weren't, and they faked a safety certificate, you may have some recourse. However, it will be difficult to pull off so to speak, as you will need to find who it was, and it will be a real game trying to take action against them.
Looks like you may need to get a new boiler.
On the positive side, you will have a shiny new boiler that will last YEARS.Oh stop waffling on. I'll give £100 to your chosen charity if you get proof of any compo from the vendor.
And as you yourself state that's unlikely.
So the advice stands. Buy a new boiler. Nothing clever about that. The OP turned first.
And the question has been answered. No compo and buy a new boiler.ladymagpie wrote: »Calling me cupcake is condescending. Lots of people have written long posts detailing why without needing to resort to remarks that appear to be trying to funny and without belittling me. But I guess that requires thought.
Maybe you should take a look at the helpful post underneath your last one.Stop being so precious sugarpie.
You are being oversensitive. Perhaps that's yet another reason not to use a public forum.
And please don't resort to the infringing my 'uman rights / disrespecting me response.
There is absolutely NO NEED for such rude and condescending remarks. It's 2016, not 1956, and men talking to women like that is just embarrassing. I can't believe that this still happens. Women have worked so hard for so many years to be high achievers and to get respect, and then some misogynistic caveman comes on and talks to a woman like this. If you spoke to me like this in my place of work, you would be issued with a written warning. Call me all the whiney, moany women moaning about my' UMAN rights til you are blue in the face. You are not important enough for me to care.
By the way, the username 'marksoton' started on the OP, and then the username 'GM' answered a post directed at 'marksoton.' Better make sure which username you're logged in under before responding to posters in future. You have given yourself away there.0 -

the advice would be the same regardless of gender - ie the op hasn't got a leg to stand on, the boiler worked when they moved in no warranty implied. And stop being so precious with your gender offensive comments such as "misogynistic caveman" im female and comments like that put the femist movement back. As well I suggest you read the advice about being nice to posters

You have given yourself away there they are different people GM does like referring to cakes but mainly because he likes to sort out difference over a nice slice of madeira or chocolate cake .

If it was fitted in the last seven years by someone that claimed to a Corgi registered fitter then they have got problems as Corgi ceased to exist on 1st April 2009 and a was replaced by Gas Safe. However, if someone said they were a CORGI registered fitter and they weren't, and they faked a safety certificate, you may have some recourse.0 -
I wouldn't rely on British Gas, they want to condemn your boiler in the hope you buy a new one from them. Find (ask around friends etc) for a local gas safe registered engineer and see what they say.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Can we cut all the petty cr*p??
The OP is after advice. This is a money SAVING forum, so if there is some way to save them money, then that is the advice to give.
There is no point telling the OP to buy a new boiler yet. She needs to check the paperwork. If it specifically says that the boiler has been serviced, then paperwork should have been provided, giving details of WHO did the work.
Our boiler had NEVER been serviced, so we put this on the form, and our buyer chose to have it looked at.
If the paperwork states that the boiler has NOT been serviced, then looks like it will be a new boiler.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

There is no paperwork, there never will be any paperwork. The OP is flying in the wind of a casual question.
And even if there was it doesn't make it enforceable.
So, and i'm now even getting annoyed myself. Buy a new boiler.0
