Sold a house with a dangerous boiler! Where do I stand legally?

    Go back to the original TA6 form. Look at question 12.3. What does it say? Can you be sure about when the boiler was installed? Did they give you a date that looks correct? Did they provide an installation certificate?

    If they've lied, and you have evidence to support this (e.g., boiler was a 2007 model and they indicated it was 2003 to circumvent the need for a certificate) then you might have a case.

    You were responsible for checking the boiler, either via proper paperwork provided, or by employing a GasSafe engineer to inspect.

    I'm afraid no one i to blame but yourself.

    Why are you getting BG out? A local independant GasSafe engineer will be far cheaper. Yes, choosing one is hard (there are good & bad) but BG engineers are also good & bad - but are all expensive.

    Get 3 different local engineers round to quote.

    Then get a 0% credit card instead of a payment plan.

    British Gas will be twice the price. Find a different way of paying!

    Not all tradesman will accept credit card payments, check before you get them to come quote

    There is a possibility that the old boiler is functional though incorrectly installed. However, it probably wouldn't be wise to uninstall it, fix the mess behind it, and then reinstall. The boiler installation cost itself is often more than the price of the boiler.

    I also can't see anyone other than a GasSafe engineering touching it, so I'm not sure what you meant by "remedial maintenance company". Wasn't it cowboys that got you into this mess?

    I dont think you have read anything I've posted -
    I said I'm aware it'll be buyer beware.
    I said one engineer has refused to touch it already.
    I said I believe the sellers have lied to us. Lying is different to me not asking the right questions so if I can prove that then I can be compensated.

    Two other companies have refused to even look at it. So far, british gas are looking Iike my best bet.

    It was a gas company who told me to get a maintenance company out after they refused over the phone to look at it.

    That's not unusual. I had to contact about 8 to get a roof sorted. Five never followed up with a quote. 2 quoted for work I didn't want. 1 quoted for something slightly different but that still fixed the problem.

    Generally, tradespeople don't like fixing someone else's mistakes. You have to work that much harder just to get a quote.

    Ladypie - i would seriously check the TA6 form asap and check question 12.3(b).

    If the answer is after 2005 then you have a case to claim.

    if the answer is before and you can prove the boiler was installed after 2005 (manufacture date) then you have a case to claim.

    if it was really installed before 2005 then im afraid no case to claim and you will be ou tof pocket ima afraid.

    12.3 (C) may help but would be difficult to prove.
