    What if you tried to sublet your room? Would your flatmate make the life of the new person unbearable?

    At least perhaps you could you move in a friend temporarily, so you are not on your own facing the bullying?

    You could also try to re-coup your losses by renting it out on AirB&B.

    Your flatmate is bullying you. Perhaps when she realises she cannot get everything she wants from you she would calm down?

    You are in a bad situation and you need to consider what's lesser of two (or three of four) evils. Perhaps you cannot get out of this situation with your credit record unscathed?

    Without the exact wording of the break clause I don't know how anyone on here or shelter for that matter can give an informed opinion, your legal advice at the university obviously has seen the wording and therefore is more informed.

    If the letting agent contacted the other tenant advising she would have to be re-referenced as a sole tenant this implies they have either accepted the break or know they are on shaky ground as the wording is ambiguous.

    If you were giving normal notice after the fixed term then one party can give notice to end a tenancy.

    It all hinges on the wording of the break clause and the rest of the contract. It sounds like the letting agent have made a pigs ear of it.

    I have to ask did you know the person you were going to be sharing with before you moved in and did you both sign the tenancy agreement at the same time or were you complete strangers and have separate contracts ?

    Well head office were under the impression my flatmate had agreed to take on sole responsibility, which she hadn't, and that's why they phoned. I can come off the tenancy, but only with her permission I understand.

    I didn't know her, no. We signed the same contract, but at different times. She was away until a couple of days before our tenancy started so I'd never met her

    Eh? The tenancy was agreed on the basis of there being electric underfloor heating per the EPC. The fact that it isn't working (and hasn't been fixed in a reasonable time) would be reason enough to break the contact. How can you justify the statement above?

    because the laws around this in the UK are a joke.....the landlord/letting agency can state what they like and you have very little comeback when it comes to the state of the property. Its all well and good having a contract in theory but when you try to enforce things like this they can just wriggle out of it by saying the issues 'aren't serious enough to end the contract'.

    One of the main reasons I was so glad to finally buy a property was to get a away from the fantasy that 'renting is great, the landlord handles all maintenance and you just enjoy the property'. the reality is far from this.

    But that's why it is also mad to agree to sign up a 12 months contract moving in with someone you don't know.

    If at least it's been 6 months, even better with a 3 months break, it would have mean that at best she only had to cope for 3 months, or if the flatmate was to be a pain as this one turned out to be, it is only 6 months.

    I know I'm going to sound really spiteful, but why don't you make your flatmate's life hell to the point you can drive them out of the tenancy. You can always call up your utility companies and change the name to your flatmates. Also stop doing your share of the cleaning in the house.
