CCJ - Parking Eye

Thank you Coupon-mad, I plan to search through all the threads tonight so I know exactly what I need to do. I definitely want to get it removed rather than pay and still have it on my record.0

Quick question - as I've had no correspondence other than the initial letter, and the rejection of appeal letter from PE (which stupidly I didn't keep), I don't have anything to reference on the N244, other than the case number of the CCJ. Do I need to ask PE for copies of letters? I can't even remember when this happened.0
-
yes you will be doing that after the set aside0

Even though this is a money saving site, do not be tempted to save money by cutting corners. Personally, with something as important as this is to you, I would hire a solicitor specialising in this sort of case.
Who knows, you may be able to claim it back from PE if they have acted deceitfully. You never know how far you can go until you go too far.0

I have filled in the N244 form and am just working on my witness statement. I am using the template and information provided by Parking Prankster, and just taking out the bits about DVLA as not relevant as no address change, I just never received the letters beyond the initial invoice.
As for a solicitor, do I need one at this stage? My priority is to get the CCJ set aside, and then I will decide if I continue to fight the claim or pay?0

You can't reclaim solicitor's costs, so no.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, but those costs for 'unreasonable behaviour' are rarely awarded, and the defendant would have to clear some high hurdles to establish that the claimant behaved unreasonably.CPR27.14.(2) (g)?

The fact that she never responded to the initial claim means she's starting on the back foot, so that won't happen.
Plus employing a solicitor is a waste of money in a private parking case, 99.9% of them just don't grasp the nuances of this specialised subject.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0

I am aware of that, but CM categorically states that they are never awarded. Do you therefore not agree that she is wrong?

Once again, I agree, but you will see that I mentioned a solicitor specialising in these matters, not some High Street conveyancer.
As for being a waste of money, I would say that BMWs, flying first class, holidays in Dubai, and marble worktops are all a waste of money. You never know how far you can go until you go too far.0

Parking eye are a nightmare. I have now got a nice lil ccj. Cars registered in my name, however, I wasn't in the car it was my husbands daughter. I have told them it was her because of this ccj and they don't want to know. All I can do is either wait the time pug or pay it.0
