Hi,
I am looking for some advice please.
I have to park in motorway services when I go into the office, it's always been £10 for the day. Back last year, I went into one of the shops to pay for my ticket to be told that they had changed the tariffs and I only needed to pay £6 as the first two hours would be free.
A few weeks later I received a ticket from Parking Eye stating that I had stayed for two hours longer than I had paid. Remembering what I had read about these private parking companies, I came onto MSE and decided to appeal it, which I did. The appeal was rejected and I received another demand for payment. Believing they couldn't take this any further (perhaps I should have done more research at this point), I did not pay the fine. From memory I think I received one further letter from them but then nothing for months. I have just been checking my Experian report and was horrified to see a CCJ that had been issued on the 9th February regarding this unpaid ticket.
We are looking to move house at the moment and obviously a CCJ will have a massive impact on this.
Can someone please advise me on the best course of action here?

it is £155 for a set aside if you can get it, then it still needs to be sorted out

Have you moved house since the PCN, and not updated your address with the DVLA? If the answer is no the fault may well lie with the DVLA, who may have given PE an incorrect address. In which case, I would engage a solicitor and go after the DVLA.You never know how far you can go until you go too far.0

1: PPCs are only allowed to get the information of a keeper ONCE per incident

Nope, I haven't moved. I appealed based on PEs first letter (this was an online process I believe) and then I must have have received a letter saying it had been rejected, but I didn't take any further action at this stage.
I do not recall receiving any letters after this and the CCJ has been a complete shock to me, I only happened to notice it because I was browsing my Experian report this morning. There is no way I would have risked it getting to this point knowing that we intended to move this year so I genuinely don't think I received any other communication from them.
So from the reading I've done this morning, it would seem that my best bet is to try for a 'set aside'?0 -
Yes, a set aside it is, but you should check with that the court sent you the notifications at the correct address. Did solicitors send you a letter before action? Rather a lot of correspondence seems to have gone AWOL.You never know how far you can go until you go too far.0

Ok, I've just rang the court. Firstly he said I should have received one letter from them on 11th January which would have been a 'Claim Pack'? I asked him to confirm my address details and they were correct. Towards the end of the conversation he then said 'Oh you should also have received one confirming the CCJ on 9th February?' I definitely have not received either of these!! We were in the middle of applying for a new mortgage at that point, those letters would not have been ignored!0

So you need to set it aside because you are too late to pay it off without it still showing on your record for 6 years as 'satisfied'. Setting it aside removes it and allows you to then defend if the PPC proceed.
Search the forum for the words 'set aside CCJ' to read other threads and save us repeating what's already here several times over! You'll also learn more from other people's cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
