I still don't know what will happen about our bank account.
We are going to the courts on monday and I've no idea what will happen to my benefit money that goes into our bank account.

Like you I had a catalog but had not missed a payment and had a small balance,it didnt even get rememberd on the form:o so still have it.
No one comes to your house to check unless they think you have a Rolls or a Chippendale hidden away.
As mentioned before we opend our COOP account prior to BR it was not frozen as we needed it for wages / beniffits .You can apply by phone.It might be a good idea to do this anyway so you have an account to use if the one you now use is frozen.
Please make sure all cash you need is removed before you go BR.
Can you have beniffits paid into a freinds account for now until sorted?

As suggested get all your money out and maybe use a friends account. A post office account, i believe, is not touched by the OR as only benefit money goes in so could you open one of them?
What happened to me was, i opened a new account at the Halifax before BR in the hope of being able to keep it. It was frozen, then closed down. LOADS of hassle then as i had DD's due to come out within the next few days. I then went to Barclays who set up an account and were lovely (but still took nearly two weeks to get all cards etc). I think if you explain to them your going BR and ask for there basic account you may find it gets briefly frozen but will be fine once your OR gets in touch with the bank. I think they can unfreeze it straight away.
From what i've read everyone has had different experiences with there accounts, and most suggest opening a new account as soon as you walk out of court.
I don't know if the OR watch your accounts after BR, most seem to busy to do things like this at the mo.

Thanks so much everyone I'd be absolutely in hell w9thout your advice and help.
I have to say, I didn't sleep last night, and I'm really worried how we will live if our bank account gets frozen. I only have our benefits going in there and all our utility bills are paid through the bank.
I can't go to barclays as they are our main creditors, we only have a basic account with nationwide. It takes 4 weeks to get our benefits paid back into the post office.
How do we live it our nationwide account gets frozen?0 -

Madeline would it be possible for you to contact the Benefits agency and ask them to pay your benefits by Giro cheque until you are able to open a Post Office account. They would normally do this as soon as possibel. You would then at least have access to your money whilst you are going thru this difficult time.

Thanks, but they don't do that any more, we do have a post office account and have already phoned, they said it could take up to 4 weeks to transfer it all again.0 -
Personally I would be surprised if the account is frozen for very long.
We've heard of people having problems opening new accounts with Nationwide once bankrupt, but I don't recall any examples of an established account being frozen for more than a few days until they hear from the OR. We can't say 100% that it will be OK, but it probably will be fine.
Even if the account is frozen, most accounts will still accept payments in (just not out). Because these are benefits (or funds) that are essential to live, if this happens the OR can demand that Nationwide releases them to you.
If the worst case happens and a payment bounces, then most benefit agencies can organize an emergency payment by other means (so I'm told).
