  • Sorry I have not been able to update this sooner.
    I had another stroke 2 weeks ago. unfortunately it has disabled me further. The doctors have warned me that stress is a big contributing factor, and a further stroke could be fatal. Because of me being in hospital, I've not had chance to try and sort out the bankruptcy.
    My family have all stepped in and between them and the bit we managed to find, we now have the money to proceed with the bankruptcy. It has left me feeling extremely down, and I feel very bad taking money off my family as they are not really in any position to go giving out money.

    The stroke has also made me a bit confused, I keep forgetting how I do things, plus my memory is a bit foggy.

    Can someone tell me, once we fill n the forms, do we need to make an apoinntment with anyone? were do we go with the forms?

    Hi. Sorry to hear the news about your health.

    Hopefully once all this stress is out of the way that will be a big help towards you making some improvements. :)

    You need contact your local County Court to find out when you can take the forms in and petition for bankruptcy. At some courts you have to make an appointment in advance, while at others you don't. Contact yours to find out.

    If you are going to have trouble getting to court yourself, then they should also be able to tell you how and if you can get someone else to do all the court stuff for you.

    Hi Madeline - Sorry to hear that you have had another stroke.

    You need to take the forms to your local county court, worth a phone call first, to check that they handle bankruptcies - not ALL County Courts do.

    Some Courts operate on an 'Appointment Only' basis, although I believe that most can handle an 'instant' case if you explain your personal circumstances. CAB will be better able to advise.

    I'm really sorry that you are having to go through all this, in your current state of health - says something about 'the system' to me.

    Sorry to hear that you have suffered another stroke, I cannot give any more information than the others have already given> I just wanted to send my best wishes, I hope you find help with going through the court process!

    Keep posting and talking about it, when you feel upto it, that in itself, relieves some of the stress.

    I too am very sorry to hear about your stroke. What has happened with the CAB? My local CAB helped fill in all the forms and then rang the county court to book the next appointment for me. My brother is coming with me, but they said if he hadn't been they would have come. Apparently this is something they do often. I was also told that on the day (WEDNESDAY THIS WEEK) then to ring if I have any problems and my advisor will make sure I am put through no matter how busy she is. I had to wait 3 weeks for my court appointment, which according to my advisor was a long time, it is usually about 2 weeks at the most. If you want me to I can post all the information of what I went through on Thurs or Fri? I would advise you to sort out for a court date, preferably therought the CAB as soon as possible, because the sooner you are bankrut the sooner you can start managinvg your money, your health may get better because of less money worries and maybe you can put a little on one side every wek to pay back your relativees. Even just a couple of pound and then when it has built up a bit, pay so much to each one?
    Anyway, keep in touch. I hope you get this sorted quickly, the relief will be enourmous.
    Thanks to the debtdoctor and any other people who work at the CAB who read this. They are fantastic people who are not recognised enough.
    Be thankful for what you have because it could all be taken away tomorrow.;)

  • Thanks again everyone, we have almost filled in the forms, we can't make it to the courts tomorrow as I have hospital apointments, so we will have to go monday morning.
    We rang courts up and they were very nice, spoke to the person who deals with bankruptcy and he was very sympathetic and explained everything.
    He did say if there is no judge available on the day we may have to wait but it will be no longer than 21 days.

    I have a few more questions that I need sorting.
    First is
    I have had a catalogue account for over 20 years, never missed a payment and never bought anything unlesswe really needed to. The acocunt is used mainly to by my husbands clothing, he is a very large man and it is the only place we can get clothes and underwear to fit him.
    I owe them aprrox £80 and I'll be honest, we would be totally lost without them.
    Do we Have to declare them as a creditor and if we don't, how will anyone find out that we still have an account with them?
    I don't really know what to do for the best.

    Second does anyone actualy come and visit our home at any time at all.
    Are our bank accounts monitored from the moment we put the papers in?

    I have a catalogue also, but it's used by my daughter and before BR i got her to pay it off in full (was only £60) I never mentioned it to the OR and he has never mentioned it either.
    From what i've heard they are so bogged down at the moment they would be hard pushed to find out. That said,i would never advise you to decieve the OR and maybe an honest admission and the reason you need the catalogue will be ok.
