Thomas cook compensation

Options
Hi

I'm hoping someone can advise me......

I had a 12 hour delay with Thomas Cook last year for which they refunded the full amount of the flight cost.
My question is whether I can claim additional compensation? The woman at TC has advised me that I can't - is this correct or are they just yanking my chain?

Any advice would be great.

You say they refunded the full cost of the flight did you get compensation as well. were you delayed overnight? did they give you vouchers for food? What did they give you?

    Hi Justice,

    Thanks for replying.

There were six in my party - TC refunded the full cost of the flights after a delay of 11 and a half hours. We didn't stay overnight but they were incredibly generous and gave us all an 8 euro voucher to spend in the overpriced food hall at Menorca airport which pretty much got us a bottle of water and a bun so happy days...........

No compensation was paid in addition to the refund of the flight cost. I was expecting compensation of around £190 per person travelling but as I alluded to in my previous post the TC complaint handler said that as they'd refunded my money no further compensation was due (and quoted some EU directive - the name of which I've forgotten)

A little mixed up. You say you were delayed 11 1/2 hours was your flight cancelled? how did you get back and what did they say was the cause of the delay/cancellation.?Post your flight details

Technical fault initially. A part was flown out to Menorca but it was the wrong one. Another plane was flown over to bring us back. I don't know if it was cancelled as such, sorry.

    The flight number was TCX7462

    Thanks

what was the date? from which airport to which airport? Why would they give you a refund for your flight if they flew you home the next day doesn't make sense. Were you in the airport overnight if yes they should have paid for a hotel for you and your group. If you paid for a hotel you can claim it back

For a delayed flight within the control of the airline where the airline eventually gets you back, you would be due EU261 compensation and not a refund
For a delay of over 5 hours you can choose not to travel and receive EU261 compensation plus a refund of the ticket price
As they did transport you back, I cannot see how you would be entitled to a refund plus compensation...how did the refund amount compare to the compensation?
  • you really want compensation as well??? I think that the flight prices will really increase if all go for this compensation. just my opinion of course but Martin Lewis did say on the tv, if you were delayed but didn't really affect you, then its down to morals. Did this delay cause you any other money loss that wasn't covered by your compensation?

Those flight details were for a flight from Stanstead to Menorca I thought it was the return flight from Menorca to Stanstead? If you were on the flight you would be due compensation as it landed more than 3 hours late as long as it wasn't down to extra ordinary circumstances

although not sure why they refunded the flight as that would not have been due unless OP chose not to travel...I am wondering if it was a similar amount and badly worded or they refunded in error
