When I applied for tax credits, they put me instantly on a tax credit examination, I had to provide all this info they laid out... which i provided everything I could seeing as I had only been doing it for just over a month, it was difficult.

I got the letter stating what i did in my first post, from the tax credits examination people. B&C Compliance Operations at the top of the letter.

It states we'll send you another letter which will explain this decision and your right to appeal.

Well the link I posted still applies then. You just need to wait to see if their letter gives any more detail to help you in fighting your corner.

Personally I would try to speak to them first but I don't know if you have done because you haven't answered that.

It's not just about invoicing the company. Your account has to show payment for the work as well. They are not just looking at what you say your income is, i.e. the invoice, but evidence of you actually being paid for that work. Since this work is quite new, have the company paid you yet?

Online work is fine, provided they can see the payment for the work you have claimed to have done coming through to you, clearly marked as to the source, i.e. the name of the company(ies)/agency(ies) paying you.

The company paid me for my work in Jan 16th til 31st... Since I invoiced them for it, They sent me the letter mid Feb asking for all this info. As stated I invoice monthly. They saw payments made from the company direct to me for the period of 16-31st.

It's difficult to show its a viable "business" when they won't even give me time to invoice and get paid in that case.

No I haven't spoken to them, I spoke to them when my claim was taking forever, and got told it was fine... and then next thing that day they issued an examination, that was 17th Feb.

Thanks for all your help, I will phone them next week, to see if I can get any info, and if that fails await their decision letter to ask for a reconsideration.

I work 30 hours per week for a small company as self employed, I choose when to work etc The hours are split mon-sat and sometimes I work over 30 hours per week. I started this on the 16th Jan 2016.

I also have income via eBay and my own website, as well as jobs I do for other people.

This puts me on about 30-36 hours a week, at just over minimum wage.

HMRC wrote to me saying I quote:

"I'm unable to award your claim because from the information you have provided I cannot confirm that you are in remunerative paid self-employment for 30 hours or more a week".

Ok so despite including invoices to people I've invoiced, Statements, Paypal statements, Website addresses, Advertising etc

How can I possibly prove I work 30+ hours a week? My hours are verbal with the company, theres no paper contract... I invoice them per month.

    Do I even bother appealing?

    Yes, definitely worth appealing.

Request a mandatory reconsideration in writing.

HMRC seem to have sent a flurry of these examination letters out in the last 2 months and some were in error.
Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

How long do they take to pay, i.e. once you invoice then for February? If you can show HMRC the payment coming through to your account, i.e. a full month's earnings, it may sway them to consider your business legit. Once you know what the invoiced amount will be, you could call them requesting an explanation but also supplying the updated information. Ask them if they would then need a copy of your bank statement once the invoice has been paid.

It's worth persisting with this, imho. Even if your income is around £10k - £11k for the year, that would still qualify you for around £100 a month in WTC. That's money to see you through in case the company is late paying, a sale doesn't go ahead quite as planned, etc.

Hang in there. It can take 6 to 8 weeks for a new claim to go through, but it will be backdated to the start date for your claim once it comes through.

I just phoned them, as helpful as a chocolate teapot... they said they have suspended all payments (not that I got any to start with), and that I could ask for a mandatory reconsideration, she asked would that be something i'd like to do, I said yes, obviously... she said she'd make a note thats what I was going to do.

Something for me to do next week it seems.

Makes me laugh, If it's not viable, should I just pack up and claim job seekers instead? I mean £100 per month next to £70 odd quid a week, and they're begrudging me it despite me actually working!!

But if you are working 30 hours a week and only getting £70, why is the company you are working for paying you so little? Shouldn't it at least be the NMW for the hours worked?

Think OP is referring to JSA which is just over £70 per week so more than they are getting in WTC.
