Tax Credits Claim Denied

I work 30 hours per week for a small company as self employed, I choose when to work etc The hours are split mon-sat and sometimes I work over 30 hours per week. I started this on the 16th Jan 2016.

I also have income via eBay and my own website, as well as jobs I do for other people.

This puts me on about 30-36 hours a week, at just over minimum wage.

HMRC wrote to me saying I quote:

"I'm unable to award your claim because from the information you have provided I cannot confirm that you are in remunerative paid self-employment for 30 hours or more a week".

Ok so despite including invoices to people I've invoiced, Statements, Paypal statements, Website addresses, Advertising etc

How can I possibly prove I work 30+ hours a week? My hours are verbal with the company, theres no paper contract... I invoice them per month.

Do I even bother appealing?

    Can you clarify what you mean by working for a company?

    Is this your own ltd company? Are you a director?

    I was hired to basically run the admin/shipping side of it - I also run their social media accounts. (I work from my home, their business is 3 hours away from me), They make money, I invoice them my fee's, they pay me.

    I pay my own NIC and Tax.

    So it isn't your company?

    What evidence did you provide? Do your invoices detail working hours?

    No it isn't my company, if it was... I wouldn't be needing tax credits, thats for sure.

    My invoices give dates and a qty of hours worked between those dates. This obviously wasn't enough info.

    Sorry, but it makes a difference hence why I asked!

    If you genuinely think you are entitled then yes you should appeal their decision (although ask for mandatory reconsideration first).

    Surprised it was even selected if your profit is over NMW for 30hrs.

    If you genuinely think you are entitled then yes you should appeal their decision (although ask for mandatory reconsideration first).

    Surprised it was even selected if your profit is over NMW for 30hrs.

    Well I'm working 30 hours a week, I'm earning over NMW but will be less than the living wage (this applies to me). Does that make a difference? I just dont see how I can prove I work 30 hours+ lol All my work is online, within a shared network. I don't physically go out to work, I don't have massive amounts of expenditure, I work from home in my office, I don't even class my broadband/electric as expenditure... lol

    What does a mandatory reconsideration mean?

    £300 approx a month from ebay (selling livestock i've bred), £100-150 a month from other bits I do

    As for 30 hours a week, I think since working for the small company, I've worked one week at 30 hours, the rest over it...but it doesn't matter since it's still over NMW I can do 40 hours a week and still be slighlty over NMW

    What does a mandatory reconsideration mean?

    Living wage hasn't started yet so wouldn't be relevant to any check they do.

    Have you tried talking to the officer in charge of your check and asking them to explain their decision in more detail?

    It means youre asking them to reconsider their decision.

    So how many hours do you actually do for the company? Maybe they are satisfied with the hours you do for them, it's the rest they are not satisfied with?
