You really ought to see a GOOD solicitor asap."A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

The problem with that is that I cannot afford one, he has left me with a lot of debt from when we first got into the house and started to improve it, I've been left in a really bad position
I was just wondering if that it was fixed term if he can force me to sell while there is a child in the property0 -

I have an 8 year old child but he is not the father
He would have to pay out to go to court to force a sale.
As the house is a child's home, you wouldn't be forced out in a hurry.0 -
Thank you so much for that, it has definitely put my mind at rest
I am worried he will stop paying his share, I have advised him it would end up with a repossession order and he would be on the repossession register for 6 years, he has always been really sensible with credit so I'm assuming he wouldn't want this as he'd not be able to get another property any time soon0 -

It's a bit much to expect him to keep paying the mortgage if he also has to pay rent somewhere else.
Both of you are responsible for the mortgage - if he stops paying, you will have to find the money otherwise the mortgage company will chase you. As you are at the address, it will be easier to pursue you for payment than your ex.0 -
He has moved into his parents four bedroomed house where they reside alone so he has a home to live in rent free, they also spend a lot of time abroad so it is not a hardship for anyone involved him being there0

He could still stop paying the mortgage as a way of trying to force you out.0 -
I know, this I think is my worst scenario
From there if I could pull the money together each month would I be able to keep the property still?
I'm worried that if I scrimp and save he will then expect to get his hands on his half that I've had to pay - or could I prove what I've paid in court?
This is so messy it's unbelievable0 -
So you expect him to continue to pay a mortgage, but not live in the house and not get any rental income from it?
If the roles were reversed would you do it?Weight loss challenge, lose 15lb in 6 weeks before Christmas.0 -
If I had the luxury of staying in my parents house rent free and a child was involved then yes
Unfortunately I don't have that luxury and have nowhere else to go or I'd happily let him live there
If he really wanted to he could take the spare bedroom but seeing as he won't make contact with me other than facebook......... then I don't think he'd be up for that
Please do not make me out to be in the wrong here
I'm trying to keep a roof over my child's head and avoid financial ruin0
