I've heard back from Aldi now (at long last).
I had a phone conversation with someone from Aldi parking management and he said they would cancel the charge but they couldn't do that unless I withdraw the POPLA appeal.
He said because it's with POPLA I have to withdraw it. ParkingEye can't withdraw the charge becaue it's gone to appeal. I said I would not do that without written confirmation that the charge would be dropped.
This sounds really dodgy to me.
I do have an email now from aldi which says
"Thank you for taking the time to contact us today regarding your parking charge. The decision has been made to cancel the charge for you on this occasion and we will be notifying Parking Eye of this immediately.
It is important to note that Parking Eye cannot action the cancellation until your appeal to POPLA has been withdrawn. This is because Parking Eye cannot action a charge whilst it is currently under the appeals process with POPLA.
We would ask that you contact POPLA and request that your appeal be dropped with immediate effect. Once this has been done, please contact us to confirm the cancellation of your appeal. Once we have had that clarification from you, we will of course notify Parking Eye so that they can cancel the charge promptly."
Even though I have written confirmation, the last thing I want to do is withdraw the appeal and then find they don't cancel the charge.
Surely ParkingEye can write to me and withdraw the charge? Or they tell POPLA they are withdrawing the charge?

no way would I cancel a popla appeal
PE could choose to cancel it , but if you cancel it and it all goes pear shaped there is no way back
a 12 minute "overstay" is well catered for in the BPA CoP , so as the popla appeal is already in I would leave it there, on file
the supermarkets were "STUPID" in employing these par@sites to harass genuine shoppers in the first place, dont give them any more business0 -

The perfect email to show a Judge.
It is probably because it costs Parking Eye £27 to give you a PoPLA code which they cannot recover.
Tough titty on Parking Eye, tough titty on Aldi.
Simply confirm to Aldi that they have cancelled the ticket and you do not expect to hear anything further from Parking Eye
No further action is required and do NOT be dragged into stupity

It is said that Aldi accept commision from Parking Eye making them the most expensive supermarket in the UK
Their own fault for employing Parking Eye, very bad move

I have been informed by Aldi ( please see attached correspondence ) that they have cancelled this charge ( for which I deny any liability ) and you will action this if I withdraw my appeal to POPLA .
Can you confirm this is the case and I will then action cancellation.
I expect a reply within 7 days but will use the aforementioned correspondence from Aldi to demonstrate the complete absence of any cause of action you may think you have should I not receive this.
