Holiday INN being unreasonable

I was let down on an office so Monday night I approached my local Holiday Inn in Bexley to book a room for the following week. The contract was scanned and sent gone 7pm on the Monday (no payment was made). First thing next morning i was told that a student was pulling out and it using a hotel room became uneconomical. I noticed them straight away and explained basis the fact that a) the timing was so close and b) the likelihood that I had caused them any loss or interruption, could this time I cancel. They refused citing a contract. This seems wholly unreasonable and i complained to IHG head office who got the hotel manager to tell me the best they could offer was to charge me 75%. The cost is 1400 and they haven't charged my credit card yet. Is it worth it telling them to take me to court for the money rather than feel obliged to honour the contract?

    What do the t&c of the contract you signed say about cancellation?
    (Although tbh I'm struggling to see why you think it's Holiday Inn that are being unreasonable in this scenario :huh:)

  • the t&cs are in their favour. The point is it was a meeting room i booked on the monday night for the following week, one of my students then notified me over the course of the night/early hours and said a family situation had meant they were dropping out - because of the situation i was not going to hold them to it, but it made it economically unsound basis the size of the class. So the very next morning i explained the situation. There is no way that between 7 o'clock he previous night and that morning I would have meant they lost business or an opportunity. So i just asked for common sense to prevail and a bit of goodwill.

    very kind of you, but presumably your choice to do this (what did the t&c of their booking say about cancellation?)

    You asked.... they offered 25%. I'll ask again, what do the t&c you agreed to say about cancellation? Is the 25% contractual or goodwill?

  • i dont see it that way, i see it as they aren't out of pocket and they wouldn't have filled that room overnight and they could have used discretion. I was running on a tight margin, but i tried to provide a good environment for a class for the few students I had and when a training option I was always using became unavailable (was let down on the promise of office space) i tried to find a quick alternative ( at a cost) which coincided with yet another person pulling out, making that cost even more so.
  • Of course the T&C's are biased in favor of Holiday Inn. It wouldn't make particularly good business sense to have them in favor of anyone else!

    They offer a service which you wanted to use and agreed to the conditions they stipulated. They have done nothing wrong.

    If you find a clause in their terms such as "Full refunds will be provided as long as no one else has enquired about the room" - then you would have a case!
