Advice - contract with Rawreth Builders Limited

What sum of money did you take him to court for?0

Oh bu99er. Not looking good for the renovations!0

You live and learn. I just found online that (text removed by MSE Forum Team)., whose current company Rawreth Builders Limited (with compulsory notice to strike off) is rather similar to another company called
RAWRETH BUILDING SERVICES LIMITED (Company number 05515934). That also had a director called (text removed by MSE Forum Team).. That was dissolved in 2012.
Hope the court accepts my contract is with (text removed by MSE Forum Team). as he never made any mention of the company at the time. Because he was related to my wife's ex boss and he seemed so nice - we trusted him....!0 -
Ok, I'll ask again. What sum of money did the court award you?
He may well be trading again but has he personally got the amount of money you are owed?
Do you think on past form he will pay up if you win? The odds say not.0 -
It was £5k in total for the bathroom floor that is still ripped out as is ceiling downstairs (text removed by MSE Forum Team).. I don't think he will pay that, which is why I need to pursue him personally as (text removed by MSE Forum Team)., my point being that regardless of him involving Rawreth Builders Limited, I believe I entered into a contract with him.0

Actually I read it was a voluntary strike off.
Wet rooms are notoriously difficult to construct and fraught with problems,in colder climates . A lot of builders don't like them.0 -
OP:
You paid £167K in full up front??
Why the hell would you do that?
Was it all in cash??
Recommendation from a friend is one thing and ok but did you actually see the work he had done on your friends house?
Why on earth did you not do better research and get more quotes from other builders?
Staged payments, as one lot of work is done you pay and so on until the work is done.
Hope you get sorted but I don't fancy your chances as I fear he saw you coming and easily fleeced you out of £167K !!0 -
Based on what you have said, I think you should still be able to sue him in a personal capacity even though you have already won a case about the same matter against another entity - namely his limited liability company. However I don't know if your previous case will complicate matters. (At the very least he may use it as evidence you knew your contract was with the company rather than him personally.)
Just because he has all the trappings of money does not necessarily mean he has assets in his name. They might all be in the name of his wife (or family members), or otherwise hidden away. And everything you see may be rented (or have other debts secured against them). Crooks can find ways of hiding money from the police (who have far more powers to investigate) far less ordinary creditors. In my view you should consider doing a credit check on him personally before taking further action.
PS - Be prepared to receive some posts that are very critical of your earlier actions from other posters. (I suggest you ignore them unless you think answering will help you decide what to do now.)
This is why I don't fancy your chances!0 -
You can stop the company being struck off due to the outstanding debt. Write to companies house with the details including the court order, they will stop the Company from folding until resolved.
If you do nothing you are making it easy for them to just do it again. With the outstanding debt they will not be able to close this company meaning they have to apply for voluntary bankruptcy, this costs them money and is a stain on the directors profile.0 -
No no no!! Other quotes yes. Stage payments yes. It was a big job.
The leaks started coming through after completion. Then [Text removed by MSE Forum Team] came back and ripped out floor and ceiling and then decided not to fix it. The cracking tiles in the 60m2 kitchen/family room floor all came after bit of time too. That's when I discovered how he maid that floor and why that's all breaking.0
