Appealing Private Company Parking Ticket

I am in the process of appealing a private company parking ticket received by my hubby and wasn't sure if I could use the signage as one of the reasons (in addition to the unfair charge). There is a large banner as you enter the car park saying that customers can only stay for a maximum of 3 hours between certain hours and on certain days but NO mention of a fine if this period is exceeded. When you are in the car park there are some signs dotted about but they are about 10 ft high off the ground which makes it almost impossible to read the details, which do mention a fine for over-staying. On that basis could I use the lack of signage as one of the reasons for appealing? A swift response would be very much appreciated as I need to submit the letter ASAP - thanks!

full instructions are given regarding appealing (dependant on company and ATA) , send the template letter shown at the time shown , do not alter or amend it , sit back and chill!
always say "the driver" not "I" was driving , and never ring a parking Co up
there is no need to rush ending a letter within 14 days on the pretext of reduced charge , done correctly you will pay nothing

Thanks. I have already used Martin's template letter but for the reasons for appealing I wasn't sure if we could use the signage as one of the reasons for not paying - there is the very large banner on entering the car park which outlines the maximum period of parking but no mention of the fine, but after that you have to be about 10 ft tall to read their detailed notices. Company is ParkingEye. I'd rather leave this out of the reasons if the large banner signage would be their excuse to pursue the matter and rely on accusing them of the charge being made as excessive.0

one minute they are appealing , the next is that they have already used a stupid template .

Hi - the template is that of Martin Lewis (whose forum this is), but having looking through the full length of the link provided in your previous response, it seems to differ quite significantly to the BPA member e-mail suggested. I did provide the name of the company - ParkingEye. I do appreciate it is not a fine, particularly as this is a private company0

Why would it confuse the OP?
It may be the "official" MSE guide, however the Newbies thread at the top of this forum, written by one of the leading lights (and she really knows her stuff) is much better and is THE definitive guide.
The former doesnt really properly tell you how to do a POPLA appeal, for example.0 -

it seems that you have received a letter from PE , probably because you were caught by a ANPR system
more info is needed in order to help
1: date of supposed offence
2: date of letter thru the door
3: amount of time (HH/MM) on site
4: have you already written to PE yes/noSave a Rachael

Because there is an official MSE website for private parking appeals it's not fair to pick on newbies who find that part of MSE and use the "official" template before discovering the forum0
