Unfair NPS PCN now £100

I posted previously about an unfair PCN on here as it was received when doing a pure gym induction where they didnt explain anything about the parking.

I was told to appeal to puregym and they never replied on multiple occasions and the gym manager refused to help.

I have since received an increased PCN.

How do I proceed?

    Send the IPC version of first appeal from the NEWBIES thread and keep proof of posting (not recorded delivery, free certificate of posting). Send it even if you've sent it before, because they have ignored you. Perhaps they are one of the IPC members who have decided that a keeper cannot appeal - shame on them, but there is no real appeal anyway with this bunch.

    Or, send a version like the one hoohoo has just written here, the part which ends 'As the debt is denied debt collection will be wasted costs on your part.' then add the keeper's name and postal address (same as on the NTK) and of course head it up with the PCN number:

    Edit - as the appeal was in Nov and we had no reply, surely the appeal deadline has passed?

    Sorry I have been away:
    My g/f previously sent an e-mail to their appeals but didnt get a reply, she has since received the £100 increased fine . In hindsight she may have to take alternative action due to incriminating herself but they didnt reply, what do you recommend?

    Hello

    I would like to appeal against a PCN I have disgracefully found on my car tonight.

    The reference and my reg can be found in the subject. I was parked in a carpark whilst using pure gym and the sign says this carpark is for pure gym users but some how I have a charge.

    The reasons for my appeal as to why it is highly unfair are:

    1. I was using the gym as the sign said so I was not breaching any rule by parking there and I was within my bay correctly.

    2. The sign says you have to register your car with the gym, well this was my induction at the gym so I had to figure out how I do that in the first place. I'm sure you can agree I can't be expected to know this on my first visit, I've never parked in the area before.

    3. It's a 24/7 gym which is manned by security pods at the doors as there may not be staff available, I was looking around for a staff member to tell me how to register my car, there was no staff in sight. They are self employed personal trainers so they d

    4. It's the first time I have ever used this car park and I had no idea how I am supposed to register my car and to make matters worse I have been fined the first time I've ever used it.

    5. And most importantly, the sign says I have 10 minutes to register my car, my car was observed as being there for 9 minutes. This means I had 1 more minute on the clock and given that the carpark is at the front door of the gym I could quite easily get back to my car in this time. Meaning that the contract was not broken as I had not been there more than 10 minutes.

    Please confirm that this has been withdrawn as it truly is an unfair charge. I always park lawfully and I have never received a charge before, a warning would have been better in this circumstance.

    As I said its the first time I've used the car park at the gym so I needed to seek instructions on how to register my car.

    A PCN is a private contract and if you sign anything on the PCN then you are in contract with them.

    Send the PCN back to them and don't engage further with them.Ask Puregym to prove you have a signed contract with them to pay these charges.
