    I am just stating my points here, I do understand that a Gale force wind is a force of nature,but you can do something to not let your bins damage people's property.

    Your points wouldn't cut any ice were you to take your ultimate route by suing the householder in court you would lose.


    (But if you make a claim off your insurance although you will lose NCD and your excess will have to be paid, then if your insurer is able to prove negligence and get reimbursed your NCD will be reinstated and you will be able to get your excess back off the negligent party)


    Arguing with us here that you are in the right is a pointless exercise.

    You have been given correct advice about the situation. If you disagree, it is now up to you to prove the neighbour or council have any liability. Good luck !

    If your own car is struck by an airborne trampoline, bin or roof tiles, a claim against the owner cannot be made unless negligence can be proved which, following a severe storm, is not very likely.

  • I am taking on board all your comments and I'm not trying to get into an arguement too even though some comment are just asking for a reaction(just like any social media platform there's gotta be be few trolls). Thank you Quentin for the mature and sensible replies and would consider what you have adviced.

    I don't get home from work till about 6pm, as many people don't.
    Wheelie bins are often out all day.

    The bin is the property of the council. The household fill it with rubbish & take it to the roadside. It's after the council have emptied it, that it's light. They are never careful about where they leave them. I really doubt they are deemed responsible, it's an accident of the weather.

    People who work in Insurance deal with your situation/complaints on a daily basis. It is really annoying when you suffer a loss, that you had nothing to do with.

    A friend of mine parked his car in an industrial area and walked to work. During the day there was a bad storm and when he returned to it after work, he found it was a total write off. A nearby yard had suffered the brunt of 70mph winds and various building parts/roof were piled up on his car. He had to claim of his Insurance and could not prove any liability against the yard owner.

    When my neighbour's tree became dangerous I wrote to him about it.

    When the tree came down in a storm six months later I was able to hold him to account to pay for the fence repair.
