UKCPS advice needed

Hi,
It sounds like a lot of people have had to deal with UKCPS here. My situation is that I received a letter stating that I was "observed leaving the site" and had to pay £60. I never saw any ticket on my car and I think its really unlikely that it was removed or fell off. I asked UKCPS to provided evidence of a ticket and they claimed that they had a photograph of my car with a ticket on it and that it would be in the post shortly. My question is, even if they can show photographic evidence of my ticket (which I'd be really surprised to see at since I never saw a ticket), surely they need to prove that I left the site with photographic evidence? putting a ticket on my car and taking a picture of it doesn't actually prove I left the site. Which I never did BTW!!!!
Obviously they were very unhlepful on the phone and pretended not to understand what I meant by requiring evidence before I hand over their new charge of £125. At least I'm assuming they were pretending to be slow witted because I simply don't believe that its unreasonable to want some evidence before handing over money to some strangers.
Has anyone who has dealt with these people found that they can actually do anything without any hard evidence apart from send letters? I'd like to think that they can't take this court without any proof but I'm ne to this stuff.

Ps, the person i spoke to also believed that it was my job to repeatedly chase them up and remind them about my request for evidence, and not their job! That's the kind of geniuses I'm dealing with here

    Yep. Ignore them then.

You should never have phoned them, they are a nasty bunch whose HQ is behind a pub in Leeds (they were on the receiving end of a writ on TV in 'The Sheriffs are Coming' a while back). NEVER RING THEM AGAIN.

Not seen any case, in seven or eight years of doing this, to go to a small claim for 'leaving the site'. NEVER. Probably because they never have any proof.

  • Thanks very much, that's reassuring. Out of interest can I ask what dealings you have had with them in 8 years, was this as a lawyer? Sorry for being nosey.
The people I spoke to were absurd and I have no interest in speaking to them again ever! I asked the first guy what he dud the understand about my question of "why should I pay you without evidence?" (And I didn't raise my voice or get aggressive) and he said I was being abusive. I had to laugh, what a pathetic cry baby!!
I'll be interested to see if they have a picture of a ticket on my car as I don't get how I would have not seen one when they issued it. Depressing that people like that exist, what a pointless life to lead

No I'm not a lawyer except an armchair one. :)

I've been posting on parking forums for that time and have a very good memory for details, points of law, points of appeal etc. I also used to maintain an entire thread here about court claims that had occurred over the years in parking cases (that thread is old now due to the Beavis case so it's not as relevant as it was).

But in all those years I've never seen 'leaving the site' go to a small claim.

Totally agree. The PPCs know a bit about me, I'm a Mum of 4 who works in a school and they also know I sometimes post here 'why don't PPC staff get a real job that actually provides a service to Society?'

The silence echoes...these knuckle-draggers, many ex-clampers, haven't got the brain cells or empathy to do anything else.

If you get a small claim then pop back here. Cases are still defendable post-Beavis especially in cases where the circumstances are nothing like that retail car park.

  • Well thanks again for the advice. Presumably their tactics and threats work more on the elderly or completely new drivers. They really are pathetic miserable people at ukcps, sadly they probably get paid better than many jobs that actually have some value to them (while they demand for money from strangers by letter for no reason and then get very upset when those strangers aren't extremely polite to them).
Hopefully won't go any further from them as it sounds like they've got to prove I left the site (logically), thanks again!

The last PPC to pursue a 'leaving the site' ticket were spectacularly humiliated in court, their lady solicitor was offered the potential of a stay in a women's prison by the Judge and their MD was summoned to a further hearing to explain why this case was brought to court.

Read about it here, this is essential reading to understand some of the finer (and not so fine) points at issue in such a case. You will also learn what the phrase 'bring your toothbrush' means in private parking circles!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Wow, they really embarrassed themselves doing that. It's a shame they're not a bit smarter and then they'd stop wasting their own time and everyone else's. They dragged a retired couple to court on claims that were completely baseless. Laughable, pathetic characters at ukcps

  • I thought the funniest thin was how sensitive they get on the phone, as if anything other than the utmost politeness is "abuse" to them, its such a pathetic response from an adult when you're job is basically begging strangers for money while pretending to be an authority figure. I wish I'd recorded it, complete crybaby! and he sounded like an adult male of at least 30.
  • expecting a photograph of their "evidence" this week, unless its a picture of me leaving the car park and my empty vehicle in the shot (which would amaze me as knew not to leave the carpark) then they have nothing. I tried explaining this to them but their feelings got hurt and they had to hang up, haha.
