  • I understand now - I have put a reminder in my diary to email the template on 27th Feb. I will gen up on the next step over the next couple of weeks so I'm ready for it after I've sent the email. Thanks again for everyone's help, I feel a lot calmer now after my initial panic.

  • Just wanted to check that this appeal email is ok to send? The PCN was issued on 4th Feb so I plan to send on 28th Feb. I added in the bit about having a permit as per the advice on the newbies thread...

    Dear Sirs

    Re: PCN No. ....................

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    In order to resolve the dispute I attach a copy of the drivers parking permit for the date the PCN was issued.

    I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    Today, I've received a letter from the "PCN Admin Centre". It says the owners details have been released from the DVLA as the client has not received any form of dispute against the PCN. It does say "Notice to Keeper".

    I sent the email I posted on here 24 days after the PCN was issued and this letter was dated 2 weeks later.

    There is no mention of a POPLA code. I was expecting a letter from Elite Management with a POPLA code...

    they have to send the NTK between day 29 and day 56 so this letter was expected, although many companies fail to send it, or send it after day 56

    this is unlikely to be the reply you were expecting as they have 35 days to consider your appeal under the BPA CoP

    yes, but only if they refused your initial appeal

    this NTK is the notice to keeper, you have appealed around day 25 and were hoping they would forget to send this NTK out, they havent replied to your appeal as yet, hence no popla code and no cancellation so far

    the NEWBIES sticky thread fully explains why you send an appeal in around day 25 (which is a keeper appeal to the windscreen ticket, not to an NTK)

    all that has happened is they have tried to comply with POFA2012 by sending the NTK within the correct time frame, nothing more

    Thank you I will re-read. The letter confused me because it's not from the same company and reads as though the charge has been passed on because Elite didn't receive any reply within the 28 days. Am I right (probably not!) in thinking I should now be waiting for Elite to reply to the appeal irrespective of this letter?
