Parking permit blew off dash - £100 fine *UPDATED POST 17*

I've been parking in the same spot for the last 6 weeks and displaying a parking permit everyday. Today, my parking permit blew off the dash and I received a £100 fine.

The company issuing the fine is Elite Management (Midlands) Ltd.

Can I fight this? :mad:

    Yes, but it is not a fine.


    Please read he Sticky thread for NEWBIES that tells you how to appeal and beat these scams. Elite are BPA members so this should be easy to win with a two stage appeal.


    Do not pay, do not ignore, do not reveal who was driving, do not miss the appeal deadline.


    This assumes you/the event are in England or Wales and the vehicle is not leased or hired.

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    That's the one, but assuming you got a windscreen ticket you should wait until about day 25 to appeal online or about day 22 if appealing by post (first class from a Post Office and get a free proof of posting, NOT recorded or special delivery.)

    Thanks again. Sorry I know I sound incredibly silly but am I right in thinking the only bit I need to change is the paragraph that begins "I believe that the signs were not..." to my own personal reason for disputing the charge?

    That would be incredibly silly and you would lose the appeal.


    Do not change a word. Mitigation doesn't work; only legal arguments will win.


    It takes a while to digest the info in the NEWBIES thread. You have plenty of time to read, re-read, and understand before you send the appeal.
    If/when it is rejected you will need to make a second stage appeal to PoPLA. Again, you have time to learn a bit about it but don't worry at this stage. The important thing is to send the initial appeal late enough that the PPC forgets to send a POFA compliant NTK, but soon enough that you don't miss the deadline.

    So I should keep it as it is even though those reasons don't apply in my case? I have read the newbies section many times over - may be I need to sleep on it to digest it! Like you said, if the best option is to email on day 25, I have a good while to understand it all so I'll keep reading :-)

    it could be a nursery rhyme ........ as long as they accept it as an appeal .........

    AND

    don't give away who is driving

    and give you a POPLA code to win with :)

    I wrote a template to stop people dropping themselves in it. You do not appeal as 'driver' about 'what happened' and the NEWBIES thread tells you why not and when to appeal.

    Good! Now look at the POPLA examples in post #3 of the NEWBIES thread. You will need them but Elite are a cinch to beat if you follow the script here.
