Fined for littering

Hi guys

My wife was fined today for dropping a cigarette butt in an arrear that has no public waste bins nor CCTV, is this fine still enforceable? Apparently the council warden witnessed her dropping the litter whilst approaching her in his car.

Personally I would of thought this fine would be fully challengable due to points raised above. Can someone advise.

    Neither of the points mentioned would be a defence.

    Does she accept that she committed the offence? Then I don't see why she shouldn't pay for both her filthy habit and her filthy habits.

    Littering is littering, regardless of the lack of nearby bins. As I smoker I tend to roll out the lit part (probably considered littering) and put the remainder in my pocket. Not ideal, of course, but at least I'm trying.

    As to CCTV? You're having a laugh, right? Since when was it ever a requirement for an offence to be recorded for a fine, or even a conviction to be given?

    If there is such a law, there's an awfully large number of people who have been wrongfully convicted.

    I'm shocked that you think it is okay to litter under any circumstances. Fair enough stomp on it to stop it alight and then pick it up and take it to a bin or put it in your pocket. I know a smoker who has a small money bag in her pocket for cigerettes until she can find a bin

    What a joke of a post. No wonder the floors are filthy with fag ends if this is the viewpoint.why are fag ends acceptable? Can I dump a Coke can? A takeaway box? Leave my dog poo on the floor as there's no nearby dog waste bin?

    A person is guilty of an offence if he throws down, drops or otherwise deposits any litter in any place to which this section applies and leaves it. [My emphasis.]

    It could easily be argued stubbing out a cigarette leaves litter behind

    I'm not going to judge your wife for smoking as I used to smoke myself, I didn't smoke in the street though. Your wife is an adult and as an adult she should know better than to drop any litter on the floor.... Does she do the same at home?
