Currys Refused Exchange Or Refund For Ipod!!

Hi.

I bought a Apple ipod from Currys, and it recently stop working,
so i took it back, and they told me that they would have to send it back
to Apple to be tested, because they have had a lot of ipods returned,
because of freezing due to people not being able to use them properly.

Well all i can say is mine has not froze, i've been using it for 10 months.

So are Currys trying it on? and am i still entitled to a exchange or refund
even though they are telling consumers with faulty units that they would
have to send it back to Apple first.

  • after 10 months they are probablly not trying it on, they are within their rights to have it checked out by an engineer, and then they may repair it rather than exchange / refund it

    You are only entitled to a refund / replacement within 1st 28 days. Otherwise they are entitle to attempt to repair the item. This will obviously require it to b sent somewhere, lost, trampled on, used byt the repair company for thier commute for a couple of months, and then returned to you still faulty.

    Or am I just being cynical.

    they have the right to get it repaired - but they must send it back and ensure it is returned to you working. sale of goods act - esp as it is lessthan 12 mths old. let them send it but get timescales from them for return and do not be fobbed off. If the repair fails then they have to replace it as they guaranteed it for 12 months under the Sale of Goods Act.

    In fairness, the amount of ipods that break, you can't expect currys to replace them all - of course they're gonna send them off to be fixed...

    Where did that (the bit in bold) come from??? Not true I am pleased to say, there is no '28 days' stipulated in the Sale of Goods Act (which obviously is unaffected by any policy of Currys which may mention 28 days....).

    However, Currys & Dixons are fairly notorious for wanting to send electrical items back to the maufacturer rather than provide a replacement or refund as is the OP's right (if the item is indeed faulty).

    However, I guess it's fair that the retailer should be able to check that it is indeed faulty, as long as they will play ball if and when the 'faultiness' is confirmed. And if the item has just frozen maybe it can be put right and returned quickly.

    But if it's considered actually faulty, then the OP still has their rights under the Sale of Goods Act. Have a search in Martin's Articles for 'Sale of Goods Act' information, and/or phone Trading Standards for advice.

    If it is faulty then Currys should offer the OP a refund, replacement or repair (OP's choice I believe, not Currys' right to insist on the latter).

    You are correct that the 28 days is not relevant, this is something that retailers tend to state for their own policies.
    If it is faulty then Currys should offer the OP a refund, replacement or repair (OP's choice I believe, not Currys' right to insist on the latter).

    Definitely not true. After this length of time, it is the choice of the retailer.
    Gone ... or have I?

    Retailers 'own' policies are all cobblers. They do not have the option to change the law. They must abide by it whether they like it or not. The 28 day thing is a goodwill thing and doesn't change the fact they have to comply with the law.

    In our area, there is a consumer radio programme daily in the week that tackles this all the time and the amount of time Curry's feature is shocking.

    Not sure if it might help. but my son's psp went faulty this week. I telephoned Tesco were we bought it and they put me through to Sony. After describing fault etc they are collecting the faulty one on Monday and delivering a new one at the same time. It may help if you telephone Apple directly and see what they say.

  • After 6 months it is down to yourself that the fault wasn't caused by accidental damage. Under the 'Sale of Goods Act 1979' you do have longer then 12 months (up to 6 years depending on the cost of the item) Retailers must ensure that goods are of satisfactory standard and fit for use. Contact consumer direct, who are part of trading standards

    The same thing happened to my ipod after about 8 months, I took it back and they wanted to send it off. I just came back the next day and gave it to a different employee and he gave me a full refund. My brother works in currys and he says that most of the time they just swap the ipod aslong as its within a year as most shops offer you a years warranty when you buy an electronic item.
