    Hi,

I know its frustrating when things are required to be sent to the manufacture however the same happened to me 2 months ago with an 8 month old ipod video. The shop sent it off, 11 days later I was called to say it was back and Apple had actually replaced it. Fantastic. A friend had the same problem with a nano (4Gb), and again Apple replaced it, and she had her new one in under 14 days.

I don't know if the majority are replaced but the timescale was certainly ok (or i thought it was) so hopefully you'll recieve a similar service!

Do you not have anything better to do?

    Anyway...

I had no problems with Currys when I returned a 9 month old PS2. They replaced it there and then.

[quote=phanco;6160538]You are only entitled to a refund / replacement within 1st 28 days. Otherwise they are entitle to attempt to repair the item. This will obviously require it to b sent somewhere, lost, trampled on, used byt the repair company for thier commute for a couple of months, and then returned to you still faulty.

Where did that (the bit in bold) come from??? Not true I am pleased to say, there is no '28 days' stipulated in the Sale of Goods Act (which obviously is unaffected by any policy of Currys which may mention 28 days....).

If it is faulty then Currys should offer the OP a refund, replacement or repair (OP's choice I believe, not Currys' right to insist on the latter).

I wish people who dont actually know consumer law would please stop quoting how they think it should work. True the 28 day statement went some time but this has been replaced with " a reasonable amount of time" and only a court can decide on exactly what a reasonable period of time is and it will be different for each item depending on cost etc. companys still use 28 days as a guide to attempt to draw a line between where the consumers right to an automatic exchange and refering them to an engineer to solve the issue. Trading standards are often unable or unwilling to involve them selves in this issue and will often have to go to court to be resolved.

Again after 10 month has passed the customer has had the item a reasonable amount time, so dont expect the unit to be exchanged in or even refunded, as the shop now excersise their right to insist on a repair, if the item cant be repaired then the shop can offer an exchange before offering a refund.

dont even go to the six year thing as you will find that it is very complex and difficult to get to work in your favour. If it was why would any store try selling extended warranties.

Even trading standards will tell you if pressed that this area of law is a very grey area open to different interpretation and really its upto a court to decide, hence why they trading standards often sit on the fence and be very vauge in what they tell you.

  • retailers sell extended warranties to make money. The six year 'thing' is actually covered under the 'Sale of Goods act 1979' I think you will find. I work for the CAB and we have helped clients get free repairs and someone actually got a replacement after 18 months. Obviously it is up to the client to prove the fault wasn't caused by accidental damage. Consumer Direct are great at helping consumers with this type of problem
  • Contact Apple direct, last time i got mine fixed it was a 1 week turnaround to holland, apple pay UPS postage both ways.

Contact Apple via their website. I had a problem with faulty earphones, contacted them and they brought replacement ones to my house by courier.

I have also had an ipod and headphones replaced by contacting Apple through the website (within 12 months). It was a fast & easy way to do it. They send UPS to pick it up with all packaging and it was returned (new) very quickly.
