Because in the Beavis case the £85 was in huge letters, while in your case the £50 is in tiny letters. The judgment relies on the charge being 'in your face', so when it is not, it is a penalty/unfair charge

Thanks for that, what is your opinion about the fact that their communication clearly stated 'This machine is out of order'

That is all it said on the screen, or words to that effect, there was no referring people to a website, or to any small print on the signage.

And I've got myself a bit worried about what the original charge was, I have no way of knowing because their machine was out of order.

You've advised me to pay the o/s parking charge, do you mean I should pay the outstanding £50 parking charge described on the letter, and then an offer of a £5 admin.

Without knowing what the original charge was, it's hard to make an offer like this.

Perhaps it is £50 to park there, maybe that's why no-one else was in the car park!

You should not pay these scammers a single penny.
You never know how far you can go until you go too far.

I agree, although paying a fair charge for the original parking, 3hrs parking, £5 say, might be something I could consider, to get them off my back. After all, that is what I would expect to pay if their machine had worked.

Then again, it is their responsibility that the machine did not work, and by presenting me with these parking charges as a result of a failure on their part, they are causing me undue stress, and the fact is, this is losing me much more money, just because I am posting here when I could be working (I am self employed), and I think it's quite rational to say that they should be paying me, not vice versa.

was there clear signage stating that

a: the car park was closed due to faulty payment equipment

b: a clear method , ie: by LOCAL rate phone call to pay for parking time

if neither of those existed then lowther properties should be chasing this mob , not them chasing you

No, the car park was not closed.

The machine had a message on the VDU screen where you make your payments, which said, this machine is out of order.

There was other signage around the main VDU screen, I did not read it. There was no reference on the main VDU screen to make payments in any other way. Paying online for parking is a new one for me.

send them there parking ticket back and ask them to post you an invoice for "x" hrs as you were unable to pay do to their incompetence ,

actually as the money belongs to "lowther estates" send them a cheque fo £5 , thanking them for their car parking facilities and explain that their agents cocked up the machine , and you could not pay , keep an eye on the cheque for being cashed

  • Just wanted to say, thanks to everyone for the advice. It has all been helpful, albeit that not everyone is in complete agreement. I will certainly write again to Park With Ease and to Lowthers, thanks for the information regarding the owner of the site.

I'd be surprised if a court did rule in their favour given the circumstances, then again, so did Barry Beavis!

over on Pepipoo , park with pain have started the court process with a user , Gladstones are acting for them (stop laughing at the back!)

I should magine tghat if this gets to court , it will be there last (expensive) attempt

PS: report park with pain to companies house , uncle tom cobbly and all , spot there geographical location or company number? https://www.parkwithease.co.uk/

seems that Mr Jonathan Robert Flatman has an interesting past https://companycheck.co.uk/director/9071983...ATMAN/companies

addresses vary between Longridge Unit A Longridge Trading Estate, Mobberley Road, Knutsford, Cheshire, England WA16 8PR and Unit F The Court Kestrel Road, Trafford Park, Manchester, M17 1SF

lots of complaints about this company

go for it , after gladstones have finished with him he will have a bill the north side of £400 , and you can have a laugh

choose your court carefully , Knutsford seems to be the home of scammers , don,t choose there
