A further thought, having just read this: http://parking-prankster.blogspot.co.uk/2017/02/ukpc-lose-shared-car-park-claim.html
The original yellow sign, over which the white sign has been inserted, contains a clamping notice: https://goo.gl/maps/Lyozi434LTP2 Could the PoFA illegality argued in the report above also apply here?0 -
Yes, good point - that could be brought into the skeleton argument, prior to the hearing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank You EEQ for the feedback on the photos, I will look further into this and build it into the next stage of the process0

Well well Well, here's the latest on this. Just received a letter from the court stating.....
General Form of Judgement of order
Before Deputy District Judge XXXXXXXXX sitting at the county court
Upon reading the papers on the court file, Order made of the courts own initiative;
IT IS ORDERED THAT
1. Claim be Struck Out on the basis that CPR 16.4 has not been complied with. The claim is incoherent and provides no facts that could give rise to any apparent claim in land.
2. Claimant may apply to have the order of paragraph 1 above set aside, varied, or stayed. Any such application to be made by 4pm on 23 February 2017
My question now is.... what does point 2 mean?0 -
It means the claimant can apply to have their case heard by further application to the court (and the payment of a fee). But it seems to me that their hitherto uphill fight just got significantly steeper.
Without going back over 115 posts, you might want to look up 'breach of DPA' on here, PePiPoo and the Parking Prankster's blog. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

OK thanks for clarifying.
I wont celebrate just yet then, however I appreciate all those who have advised and helped with this over the last year or so.
I will keep you updated if anything further occurs.0 -

Hahaha! Please tell us the lovely Judge who ordered that?! Like this one:

Nice one...nearly there unless they pay to apply to lift this order...you are following Jack Basta into legendary MSE 'case' territory now. He achieved the same thing. Your letter with the N180 seems to have done the trick!

Thanks CM - Could not have got this far without your help.
This was before Deputy District Judge Proctor sitting at County Court at Carlisle.
I'll keep you updated on whether Gladstones choose to lift the order.0 -
So its been a few months since my last post - I haven't heard anything back in terms of an appeal by Gladstones, so I can fully enjoy the victory now!
I'm so glad I stuck with the process advised on this forum. There were some occasions where I thought I'd just pay the scammers to put an end to the saga, but the help and encouragement on the forum kept me going.
Thank you again to all those that helped, and I hope this thread proves helpful to anyone else who has a similar case to mine.0 -
