    Before Deputy District Judge XXXXXXXXX sitting at the county court

    Upon reading the papers on the court file, Order made of the courts own initiative;

    IT IS ORDERED THAT

    1. Claim be Struck Out on the basis that CPR 16.4 has not been complied with. The claim is incoherent and provides no facts that could give rise to any apparent claim in land.

    2. Claimant may apply to have the order of paragraph 1 above set aside, varied, or stayed. Any such application to be made by 4pm on 23 February 2017


    My question now is.... what does point 2 mean?

    It means the claimant can apply to have their case heard by further application to the court (and the payment of a fee). But it seems to me that their hitherto uphill fight just got significantly steeper.

    Without going back over 115 posts, you might want to look up 'breach of DPA' on here, PePiPoo and the Parking Prankster's blog.

    This was before Deputy District Judge Proctor sitting at County Court at Carlisle.

    I'll keep you updated on whether Gladstones choose to lift the order.

    So its been a few months since my last post - I haven't heard anything back in terms of an appeal by Gladstones, so I can fully enjoy the victory now! :)

    I'm so glad I stuck with the process advised on this forum. There were some occasions where I thought I'd just pay the scammers to put an end to the saga, but the help and encouragement on the forum kept me going.

    Thank you again to all those that helped, and I hope this thread proves helpful to anyone else who has a similar case to mine.
