. Why would nt it make sense. Why should a householder lay claim to a piece of highway for ingress to his property. He does nt own the highway. The law is there to allow the occupier to make an emergency exit in his car. If he returns and cannot drive his car up his drive then he can park on the road alongside until its clear. This law should be made more well known. My Daughter has lots of trouble from a neighbour who never parks in her property but lays claim to the highway adjacent to the entry, not even on a dropped kerb.. Its a form of land grabbing.
What is this 'law' you keep mentioning?
I fear you are somewhat out of date.

I guess you missed this in the link that Lush Walrus kindly provided:
Due to a change in legislation your local Borough / District Council is now able to issue a Penalty Charge Notice to vehicles obstructing a dropped kerb that serves a driveway, cycle track or pedestrian access.

It isn't laying claim to a piece of land, it is allowing access, a route through. Same as any other access point or piece of road.

In years passed this was decency led, most people were polite and mannered enough to not block someone's drive. That has changed and so has the powers for the Police to remove vehicles of selfish drivers who choose to block a driveway.

There is a difference between a bonafide driveway and the road outside someone's house who does not have a driveway or has pulled their garden fence down and made a makeshift driveway.

Yes. My response was to a post about driveways.

It doesn't matter how makeshift the driveway is, what matters is the dropped kerb. Here you need to apply to the council for permission and they come and drop it for you when it is approved.

Once that is done people will be ticketed if they park in front of it.

That's what I am saying. Lots of people have made makeshift driveways by ripping down their garden fence. They haven't got a dropped kerb because they don't want to pay for it.

Small detail... No drop kerb, illegal to cross the pavement with a vehicle, so cannot be used as a driveway anyway.

Exactly. So I'll park in front of it when no car is on their fake driveway. Nothing they can do about it.
