Which by implication/extrapolation/not-sure-what-word-I-need-here would make the buyer right.

Nah, not really, cos buyer said 41 is an 8. And it's not :D If buyers are going to make demands about refunds, they shouldn't make statements that are wrong, because it diminishes their argument
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

buyer is not taking no for an answer. I know they definitely aren't a size 8 - I tried them on they didn't fit. I know the tag says that they are a size 41 which is a uk size 7.5 and according to crocs measurements a size 7. I think I am being fair as they are the size I listed. I don't want to reply to her as I'm sick of her to be honest. I've sold a second size 7 from Ravel and the buyer is completely satisfied with them.

I think you are being unfair - if I had bought them I would have been expecting a size 7 and you have admitted yourself that they are not a 7, you should have listed them solely as a size 41 - then you would have been fair.

Why don't you just accept them back and resell?

  • cros sizes seam to differ from style to style

if you looked at the link that i gave you would see that

    one style a 7 would be 40

and in the other 7 would be 41

depending on the style that you sold i would refund then resell

    41 is 7.5, 42 is an 8.

And perhaps your customer doesn't realise that crocs are meant to be a (relatively loose fit).

And, if memory serves me correctly... Ebay's own size options gave 7 or 7.5 as 41, certainly not 8. (now they only say size 7, 8 or whatever, to save confusion).

I always think if my listing is exactly correct, I stand by the sale, perhaps letting customer return item at their own cost and I keep my fees and refund the rest. If I have made a mistake on my listing that is different. If, however, there is a misunderstanding which is subjective, in the interest of good service, I would offer a refund of purchase price once items received back by me in the same condition as they were sent out.
