Buyer wants a refund

I've sold a pair of crocs on Ebay & described them as a size 7UK /41EU, the buyer has just contacted me with the following message:
[FONT=Arial, Verdana]hi just letting you know you have sent me wrong size you have sent me a size 41 that is size 8 uk not size 7 as you stated in your description i will send these back to you for another pair or a refund can you plz send me your address plz many thanks

I have replied with the following:

41 is definitely a size 7 - I ordered a size 7 from Ravel & this is what was sent - also if you go to this site you will see that a size 41 is definitely a size 7:

Which is exactly what I stated in my auction. I actually had to sell these as they didn't fit me & I bought a size 8. According to some sites a 41 is a size 7.5 but crocs are never sold in half sizes and therefore this would be closest to a size 7. Have you tried them on at all, if you have & you usually wear a crocs size 7 you will find that these are the exact same size.

I'm sorry but as I have stated they are a size 7 / 41 in my auction I will not offer a refund as I have not misled you in any way.

Is this ok or will they win if they push it further? I have a refund policy but only to refund if my description of the item is not correct.

    Good luck with it - size 8 is at least a 42. I read recently that crocs sizings are notoriously variable!

    Possibly they're too roomy for them and they're trying to find a way to make it your fault. With luck your response will make it obvious it's not.

    if you are a personal seller then these are your terms and are fine, if you are a business you HAVE to accept the return under the DSR

    if he paid by paypal then he can do a chargeback under item not as described (even if they are as described, and I agree with your sizing btw. from what I sell ) they will then have to return the items trackable but you will have to refund or they will win

    I have started buying in European sizes it saves this sort of hassle.

    The site I looked at stated 7.5 = 41.

    Tried getting into the Ravel site with no joy to see their sizing.

    Assuming (as stated) you are a private seller I would say tough. Of course the chances of a neg a re high you have to decide if its worth it.

    To be honest I've searched high & low on both crocs.com & crocs.eu for this so called sizing info but can't find. Have asked buyer to tell me exactly where it says this. To be honest I think the buyer has just changed her mind & wants her cash back. I'm not going to give it back without a fight as if she can try do this to me & she wins then she'll think she can get away with it with others. She can keep bugging me - I don't care and I really don't care about a negative as I think most intelligent people would see first what the neg was for!

    I used to think that Ebay was great but to be honest I think if they let her win I'll lose faith in them majorly. Just wish there was another site like it.

    Thanks for this but as I stated to her in my first email that some sites do say that a 41 is a size 7.5 but as crocs are not sold in half sizes this would be classed as a size 7 by them.

    I am a size 7 shoe and would never order anything other than a 41 if buying in eu sizing. I've had a look on croc.com too and the only sizing they seem to have on there is s,m,l,etc, certainly no 41=8 etc. I too would be interested where she saw this info!

    I would not refund her as you have not misled her, seems to me she has changed her mind and doesn't like them as if she already owned a pair, she would know the exact size to order.

    Keep us updated, hope it works out for you in the end.

    You might end up loosing if she does a chargeback, unless the croc shoes say size 7/41 then you've made an asumption and incorrectly described the actual size.

    I have tried to find this website but obviously cannot. I've had to ask her to send it to me in a normal cut & paste format. Thing is that the shoes said size 41 on them & when I ordered them from Ravel I went for a size 7. They did not fit and I actually ordered a size 8 from another site which did fit me. To be honest I do think that she is just trying it on. These are definitely a size 7. Perhaps I should ask her if she has ever had a pair of crocs - the fit is supposed to be big!
