    If he had been doing this on a regular basis he would not have given you his phone number-he would be selling the phones on for use with another number.

    What do you mean bumps into one?
    Most conversations can be had if had in the right way.

    TBH if is was a normal item (that could not be tracked like a phone) I would have had no chance in busting him. The guy is obviously pretty stupid to give me his mobile, but on the other hand I bet other sellers are not as 'Thrifty' as me to pursue the issue. I was also fortunate in the fact that Motorola passed his number over.

    A few years back I was on the other end, where I brought a Brand new mobile on ebay. Six months later it stopped working due to being blocked. The seller stopped responding to me basically said it was not him, and I pursued my case by using auction fraud and via ebay chat (being passed around for ages). But I was persistent and ebay eventually refunded the money. I don't know if ebay took any action towards the seller though.

    Reporting the matter to the police may help you fight your corner with Amazon, don't worry about Motorola it's their problem.

    Well by phoning her local police he's unlikely to speak to an officer. If he speaks to a call handler they'll create an incident and they will be forced to record the crime. I'm not sure that's what he wants if he gat a refund from Amazon.

    Phoning the police is clearly not an off the record conversation.

    Hence why I said he needs to know or bump into one, but you decided to question that for some reason.
