    These are horrible ignorant people. I had to get my telephone provider to block their number and my partner had to get his solicitor to send them a letter to say the debt was not his even after he provided the proof the debt was his ex wife's and not his. Ask them for proof of who the debt is with and hopefully you will have proof that you have paid the debt. DO NOT BE INTIMIDATED BY THESE PEOPLE. If you do feel that you are being bullied by them over the phone, hang up and any time they ring you tell them not by phone, letter only. When I complained about them being rude and hanging up on me they said they listened to the recording of the conversation and there was no case to answer, so obviously they condone the bad behaviour of their staff.
  • I have recently recieved a letter from BCW for a debt i have that I would consider being too small to chase up on behalf of Orange, it says it is a Formal Demand but does not say what kind of action would be taken if ignored etc and just seems to be a feeble attempt at getting money from me, is it worth chasing this up or should I ignore them and settle the debt myself through Orange? although I must note that orange have been equally as unreasonable on this matter as its a contract that ended last year and they continue to charge me for and to cancel I must pay them, so i can never stop this cycle, any help would be appreciated.

    I would try and sort this out with Orange direct as BCW will be adding their fee on top of what you owe Orange. Speak to citizens advice as they will help you draft a letter to send to Orange.
  • I had a debt several years ago, as a teen I could only pay off a very small amount at a time. So each week, a man arrived at my door to take my weekly payment from me.
    Anyway, eventually it was paid off.

    Several years later, a company I've never heard of send me a letter to demand the full amount again. The advice I received at the time was to ignore them, unless they can provide proof. This was requested by telephone on a third call. Anything done by writing, is acknowledging the debt apparently. Only contact by phone.

    I've ignored this company for a year, then today received a "final demand" from 'Buchanan Clark and Whatever'. The thing is, the debt has now expired, having not made a payment on it in 7 years, they can't legally demand you pay anymore.

    So with all the threats to take me to court, they never did, probably as they couldn't prove I hadn't already paid it. They just bully till people give in and pay, but the fact it's expired means that they can't even do that anymore. Not many know this fact and it can help several people.

    All major companies have a debt department, but it's not long till they give up chasing people. They then SELL the debt onto companies like this Buchanan who will be more willing to bully you into payment.
    So the debt with Orange has been cleared, and you now owe the purchaser instead.

    Apparently if the debt isn't recovered before 6 years then it can't be recovered after the 6 years is up. This company have made a lot of peoples lives very miserable with their tactics and the government need to control companies like this to protect people from their underhanded behaviour as not everyone has the ability to stand up to them.

    Most DCA's are ignorant bullies but BCW are reputed to be worse than most. It's been said before but worth repeating. Never phone them always communicate in writing only, if they phone and ask for you then put them on hold... indefinitely. Learn your rights and quote them in any correspondence, there's plenty of help on that here. If the debt is over six years then it's most probably statute barred which means they can't recover it through the courts and any threats to do so will be in breach of OFT guidelines, so report it and tell them you've reported it, furthermore the OFT guidelines prevent them from continuing to pursue statute barred debts after the debtor has stated they will not be paying. So, if you are sure the debt is old enough to be statute barred then tell them you have no intention of paying and are aware the OFT guidelines and if they do continue to bully you then report them. Unfortunately there is nothing to stop them then selling the debt on and you having to repeat the process.
  • I have recently found my self in the unfortunate position of becoming unemployed, due to the death of my boss and the subsequent company closure. I have lost £263 per month in income. So, being as money savvy as I am, I've been doing what I can to cut back on things. Downgrading mobile and internet packages, not using my car so much etc. I want to point out that I do not own a credit card, I do not have store cards and I have no loans or mortgages of any description. If I want something, I save for it.

    Two and a half years ago, I started divorce proceedings from my husband, who cut me off financially. Consequently, my utility bills with Npower (another rip off outfit) went without being completely paid for a while. Even though I was paying what I could, Npower passed on my dual fuel debts to two separate DCA's, Wescot (nice people) and... you've guessed it! Buchanan, Clark and Wells! I've been paying this debt regularly with them for some time now, but having found myself in dire financial straights I have had to prioritise my bills. Feeding my 5 year old son comes top of that list.

    I called Westcot, and politely asked them if it would be possible to put my payments to them on hold and told them why. "No problem!" they said. " We totally understand. We can put your account on hold for three months. Is that ok?" "Perfect." I said.

    But. Buchanan Clark and Wells? Oh no. "We can't do that I'm afraid" they said after a lengthy explanation - on an 0844 number - of how things are so bad that I eat once, every other day so my son can have four good meals a day. So I asked to speak to her department supervisor or manager. She couldn't do that either!! I said, "Can't or won't?", because by this time I was starting to get very frustrated of dealing with someone with the intelligence of a brick. But she did say that she would get someone to call me back. So NOW they have MY number!! They did call back but could only offer me 28 days, subject to me contacting the CAB and getting them to give me some advice. Er... I'm doing exactly what they would have advised me to do. Make cut backs where I can, and why oh why oh why do I have to get a third party to intervene because they refuse point blank to listen to the person who's name the debt is in? MINE!!! Having met with debt management people at the CAB before, I know that the first thing they would have asked me is, have YOU called these people to try to get a resolution?

    Oh. And if anyone does have dealings with these...... people (cough), don't do what I did and set up a card payment with them to settle your debt on a pay monthly basis. It may show up on your bank statement, but it won't show up on the bank's computer terminals when you ask to see a print out of your DD's or SO's. It means that YOU CAN'T CANCEL the payments at the bank end of things without cancelling your bank card and getting a new one! Make sure you set up a Direct Debit or Standing Order!!

    I would cancel the payments & set up a standing order for what you can afford & put it in writing to them. Its unlikely that it will go any further, it costs to take people to court & doesnt guarantee any increased payments for them.

    Of course they will tell you "they cant do it" they want as much money off you as quickly as possible.

  • To be honest, I'm not sure now how much I owe, although I believe that as I've been paying this for some time now, it's in the region of £800. I am about to call them again to attempt to resolve the situation - and get a balance - by telling them they either accept my request for a 3 month respite, or I will cancel my card and they will receive nothing. Any reasonable person will see that they have nothing to lose by accepting my request. I told them that I'd seen all these bad posts about them on other forums, and to prove me wrong about what I'd read. Seems they don't care about bad press either!

    I did wonder if contacting Npower would help. Mainly to tell them that I refuse to have any further dealings with BCW, and to pass this debt on to Wescot. I'd much rather deal with them. I have no time for people who refuse to help when they know they can. I also have no fear of anyone using bully boy tactics. Nothing and no one scares me. If BCW threaten me with the bailiffs, I just say, "Bring it on! You cant take what I don't have!"
