Help needed! Popla rejected appeal, and Premier Park are now demanding £100
Comments
-
if they are PREMIER PARK then the title of this thread is wrong and the OP should amend it, for clarity
go to post #1 and use advanced edit to correct the PPC name, to avoid confusion like this, because exact names are required as they can have similar names0 -
I've have now chanced the name.
The letter is from Premier Park, saying I basically chose POPLA to adjudicate, and they denied appeal, so payment of £100 is now required by 29th January. If payment not received, they will commence court action to recover what I owe.0 -
Like I said, standard letter. Not a letter before claim but I would respond with hoohoo's suggested reply, post #4. They wont go away but you can respond then if they revert to debt collector letters you'd be laughing at those.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

ok...so I'll send Premier Park a letter saying:
"I disagree with the POPLA verdict. The debt is therefore denied and debt collection activities will be a waste of monies on your part.
Both you and POPLA failed to take account of the Equalities Act 2010. A reasonable adjustment would be to allow me a longer grace time to investigate the car park than usual. Additionally, there was clearly no acceptance of any contract by performance.
If you feel otherwise, I suggest we use ADR to attempt to settle the matter, and I propose the Consumer Ombudsman as a suitable body"
Should I add anything else in ie the signage doesn't refer to what I did as an offence etc?0 -
Yes.
Additionally, the signage does not specify that the circumstances of the event give rise to a parking charge. I refer you to Excel v Hethington-Jakeman. You can view this on the Parking Prankster website at http://www.parking-prankster.com/case-law.html. I refer you to paragraph 21 of the judgment.Dedicated to driving up standards in parking0 -

I have now had a letter from ZZPS, telling me my unpaid PCN has been passed to them to resolve and I now owe £172.

how I should respond
You don't. Read the following link which explains everything!
https://forums.moneysavingexpert.com/discussion/5035663Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ok, thanks. I'll hold tight, ignore the letter and invest in some handcuffs, in case I need to shackle myself to the court building and protest!:)0

ZZPS are a debt collector. Toothless.
They cannot take you to court, but they may say that they might possibly consider recommending to their client that they possibly consider the possibilities of taking court action. Or something.0
