Help needed! Popla rejected appeal, and Premier Park are now demanding £100

  • I can bring this to the attention of the POPLA board, if you want. I won't ask for a re-hearing, because it is not in their power - just to ask for this kind of thing to be checked in future.

I stopped twice from posting ... thought about a new thread .....

    but

will it be better in this context ?

under the old POPLA you could ask for an appeal / review / complain to the lead assessor .....

can this still be done under the new POPLA ?

    This is from their FAQs:
    http://popla.co.uk/faqs-and-advice
What if I am not happy with the assessor’s decision?

... You cannot challenge the outcome of your appeal with POPLA. ...... If you disagree with outcome of your appeal, you will need to follow alternative routes.

Presumably the "alternative routes" are ADR or try defending any court claim that comes after the POPLA rejection and see if the court takes a different view than POPLA.

You can show huge inconsistency - i.e. had Sharon Kerr looked at it, the case would have been won:

One of the few useful decisions out of new POPLA so far, that one. All about the signs.

If you are trying to post an image you won't be able to as NEWBIES can't.

Upload the image to a web hosting site such as tinypic or photobucket then post the URL here, but change http to hxxp. Someone here will then change it so it can be viewed.

hopefully this pic will work! I took a photo of the parking sign yesterday, and it doesn't mention "driving through". So have I actually committed an offence?

wrote to church - they don't want to "get involved" - very charitable!
wrote to popla, who cannot open the case again.

Do i write to Premier Park and if so what do i say?

thanks to everyone for your input x

no you have not committed any "offence", this is a civil matter, not a criminal one

    here is the link

only a judge can decide if you have made an "error" and breached any civil contract

I doubt that you can say anything to the PPC or anyone else now

its 6 years of hassle and defend yourself if it goes to court (small claims court)

ignore the debt collectors who are powerless to act , its genuine court papers from the PPC or the landowner you have to watch out for

It's not an 'offence' anyway, however you look at it, even if you were bang to rights. It's not a fine either.

I'd ignore them and get on with your life. PPS small claims are like hen's teeth and you can use the above as evidence if ever you did need to defend it. We'd assist with wording but I honestly don't think you'll need it.

PPS will revert to the usual debt collector letters shown in post #4 of the NEWBIES thread.

its Premier Park not premier parking solutions.

I have had a letter demanding £100 or they will take me to court. Do I respond telling them to go ahead, or do i just ignore?

write to the church again, and tell them that for every letter that you receive from their agents, you will be charging the church £19 per hour for dealing with this matter.

you tell the church that they either:
1 instruct their agents to cancel the parking charge.
2 instruct their agents to issue court papers immediately, where any court claim will be vigorously defended, with the church being held liable as principal for all costs.
3 accept your £19 per hour plus costs for dealing with any letters from their agents demanding money.

Sorry, I had PPS in mind by mistake as the thread title still says 'Premier Parking'.

Tell us a bit more about the letter. Does it say it is a Letter before Claim? Is it from the PPC themselves and does it actually say it is the final notice before court? Or is it just saying 'you lost at POPLA, so pay up or we'll take you to court' (which is a more general standard letter). I would respond but this doesn't sound like an LBC?

BMPA shows they sometimes use Trethowans (solicitors) but only as a debt collector:
