Car Dealer didn't decare the car he sold me as a Cat D

  • Compensation for the price of the car. I bought the car from a garage which should have informed me it was a cat D and they didn't. Now the value of the car is significantly reduced, and I paid above market value for the car.

    They should, but they don't have to... as CAT D class as legal repair and put it back on Road and we know cars get repairs on the regular bases and every repair does not get documented Also if car number plate was visible on the time of advertising or sale then it's normally buyer's responsibility to check before they buy. CAT D are legal to buy and Sell there is no need for panic if you bought one and it runs then don't worry. All cars depreciate significantly in value.

    I originally saw it advertised on the forecourt at 3500, he said the lowest he would take was 2800. I part exed my car for 650 and paid 2150 cash.

    It wasn't until I looked on Autotrader that I found the same spec cars going for 300ish cheaper. Some were around the same price. All without a cat D marker.

    If the dealer was aware that the vehicle was previously a write off, then they are legally obliged to inform any prospective buyers of this. In fact, they have to tell people of any facts that may influence their decision about whether or not they make the purchase.

    I agree if the dealer was aware, the OP didn't take all the necessary precautions to ensure the vehicle was a safe buy for him, however the seller offered several times for the OP to attend the site to discuss the issue, because the OP is declining this, then I disagree it is all the sellers fault.

    I haven't listened to the call. Did you tell him you were recording it? If you didn't, you won't be able to use it as evidence in any case.

    This is what I thought. Surely he should have told me before I bought the car. On the telephone call he says hes unaware of it being in an accident, however the previous owner forked out £1400 to the garage because he traded it in, unaware it was a cat D. The garage must have known about this at the point of sale?

    Well that's irrelevant. If he wasn't aware, then you can't use it as evidence.
