"So, read the Sticky thread for NEWBIES and then appeal as driver. This will no doubt be rejected, but that is quite normal. What she needs to do is make a second stage appeal to PoPLA. Did she actually appeal the PCN or just say what happened. If it was an appeal she should get a PoPLA code. "

Would it be safe to post the exact response she sent (obviously removing any personal details)?

To me the email she sent was only explaining her actions - the fact that the visitor space was taken and she parked in another residents space (also included the contact details of her care company). It does not read like an appeal.

I guess we'll just have to wait and see if a POPLA code comes through so she can take her appeal to the second stage.

By emailing the parking scumpany she may have effectively already appealed as driver unless she somehow managed not to identify herself.

So wait to see if a PoPLA code or hopefully a Notice To Keeper arrives. If the former, it's PoPLA appeal time, if the latter it's first stage appeal time.

The important thing is to show her the NEWBIES thread to put her mind at rest, and make sure that she does not pay.

This was her response (omitted bits in square brackets)

Hi today I received a parking ticket. I am a care worker for [CARE COMPANY NAME] in Exeter. My client lives in [CAR PARK NAME] and doesn't having a parking space but she told me her neighbours parking number 10 is okay to park in. I have a [CARE COMPANY NAME] permit that was displayed on my car. My client has a parking badge but my company have always told me I was able to use the [CARE COMPANY NAME] permit to park in a Permit space. I have been parking there everyday for the last 2 months.

If you would like to contact [CARE COMPANY NAME] to confirm this there contact telephone number is [CARE COMPANY PHONE NUMBER]

    Name: [GIRLFRIEND NAME]
    Address: [ADDRESS]
    Charge Number: [NUMBER]
    Vehicle Registration: [CAR REG]

If you could get back to me as soon as possible I would be grateful.

    Thanks

(Obviously a bit gutted she gave them her address - but I guess they'll go to the DVLA anyway)

She has admitted to being the driver, thus saving the scammers the DVLA fee. They don't need to do that now. She has also thrown away a winning non-POFA 2012 compliant appeal pint.

Whether the scammers consider this an appeal or not, she has given away too much valuable information.
All is not lost, it just makes it a bit harder for her to beat this scam.

In this case would it be best to pay the sixty pounds and be done with it? (Obviously learning from the mistake). It feel like it might not be worth the effort.

    NO!

Wait and see what comes through the post then come back here for more advice after reading the NEWBIES thread until you understand what's going on.

If she pays it will allow the industry to continue to target visitors to hospital cancer wards, people with disabilities, line the pockets of companies being investigated for fraud because they altered time stamps on photos, and lie in court to name but a few of the goings on in this scumdustry. Does she really want that on her conscience, because that is what paying these scammers is doing?

Point taken - Obviously I'm fairly confident that this "fine" will get wiped - I'm finding it hard to get to terms with all the acronyms that are often thrown around - but I'm sure I'll get to grips with it!

That £60 must be not far off a day's wage for her ........

both of you need to get a little bit angry over this and not give in so easily .....

Sorry could just explain this point to me (Not sure what HA stands for?) - Do you mean talking to the actual land owner of the car park in question?
