    Hi everyone,

So my OH had his first court hearing yesterday, however it has been adjourned due to CAFCASS not doing a report in time.

However, he came away feeling very disheartned. He had a brief chat with the CAFCASS worker who made it very clear she thought he was wasting there time and that he has contact (however limited it may be) so should be greatful, and that he should prepare to be disapointed by the judges ruling. - That isn't the job of CAFCASS. Make notes and immediately prepare a complaint. Ask a solicitor to draft this to the judge. CAFCASS represent the child and their best interest. The judge does not have to listen to CAFCASS, nor should the lady be speaking to your OH at all in these circumstances

He isn't asking for anything which is ridiculous! 1 overnight a week, alternate occasions and some time in school holidays. - Which is perfectly normal.

He feels beaten already, there is no safegaurding concerns what so ever so no issues there.

He is going to have a phonecall off another CAFCASS worker to talk things through, but how can they make a proper judgment off a phonecall? - They don't. CAFCASS make recommendations based on whats best for the child

Any advice would be great :) I feel so helpless in supporting him.

    Make a complaint immediately.

In writing, with the help of a solicitor.

Make sure you use a family law solicitor who can adequately phrase the complaint

this is important as CAFCASS reports do carry weight, and this sounds like treating the case as anon priority.

Just want to give an update, the court process is all finished and just waiting for the final paperwork.

My OH got every request he made, he's so chuffed! I don't think his ex could quite believe it tbh and she went in there with a very poor attitude and couldn't come up with any viable excuses as to why she limits the contact!

Such a weight off our shoulders as we now know exactly what will happen :)

Just proves that courts aren't always siding with the mums and really do what is best for the child.

    Hi there,

I realise this a fairly old post. However I wanted to see if the mother has been sticking to the fixed arrangements or is she still making things difficult?

    Hiya Tyler,

Majority of time the plan is stuck too, she did however take his son away for his birthday which meant he couldn't see him, and she's not great at communicating she will sometimes tell OH quite late on that OH has something planned and contact isn't quite as planned. But on the whole a lot better! We are keeping a diary of times when she changes contact etc
