Appealing TDS decision re cleaning charges in courts

    I'll be following this as I am in a similar situation. It is a rip off, shocking service by DPS.

    I can tell you that a tenant with good evidence and a well written argument should never be over charged

    This is not true. I am a tenant with very good evidence and a very detailed argument. I am overcharged GBP 500 for a very clean flat which was left in a better condition vs. the start of the tenancy. TDS was really a joke.

    As I said, I cant explain why you were charged so much.


    But since I have not read the detailed argument you provided, I cannot really comment further.


    I wrote up a summary argument, does yours match this (third time asking)

    Yes, it does. It was a strong argument with all evidence provided. The check in report states all cleaning omissions and classifies the cleaning as "domestic" despite the agent claiming that they hired someone to do it and supplying a receipt. I provided a receipt that the cleaning of the property / washing of the curtains was done. The check out report had no issue with the cleanliness of the curtains. This is something the agency added 8-9 days later after the check out. I explained everything - what else can I do to convince the adjudicator? Yet, he awards over GBP 300 for cleaning of the curtains.


    He also totally ignores a clause in the tenancy agreement which states that unless the agent/LL provide a breakdown of deductions within 14 days, the tenant will not accept them.

    I think this is a different agency. There are three of them.

    It seems to me that there is a difference between proving that cleaning property/washing curtains was done, and proving that the standard of cleanliness was the same as when you moved in.
