Anybody know if I am entitled to my deposit back?

Hi - I wonder if anybody can help?

I booked a family holiday for August of this year. In December first choice emailed to say that they have been made aware that they have displayed incorrect transfer times in the brochure's & the transfer was in fact 90-180 minutes (we thought 40-45minutes). Having had previous transfer's of upto 2hrs this isn't what we wanted & was a reason we opted for the hotel we chose.

I have finally managed this morning to speak to somebody to be advised that we can pay £183 private taxi transfer or cancel & lose the deposit paid - neither of which I feel are fair, id prefer to cancel get my deposit back & book alternative holiday arrangements.

Does anybody know if I am entitled to get the deposit back at all?

  • I can't answer your question I'm afraid so I'll leave that for someone else however the £183 quoted will be marked up by First Choice - if you arrange your own transport it'll be a lot cheaper.
  • Thank you for your reply.

Yes I gather I would be paying premium booking a taxi transfer via First choice, its more the fact the hotel is no doubt a lot further away than we'd wanted & so traveling by taxi or coach, its still going to be considerably more of a transfer. Another family traveling with us will have a very small baby & between us we have 3 other small children to consider, all of which were reasons we looked at shortest transfers possible.

Thank you again for taking the time to respond

Surely this is mis-selling (albeit unintentionally): you relied on the information that they provided and would not have bought the product had the description given to you at the point of sale been accurate.

I suggest that you WRITE to them stating that the contract is null and void because the particulars that they supplied were materially wrong and give them a time-frame for return of your deposit. Be prepared to provide a copy of this letter to the card you used to make payment.
  • Thank you for the replies,

My husband has spoken to the bank (paid deposit using a credit card) & they were most helpful. They certainly agreed that in their opinion we should be entitled to our deposit back & so have asked for correspondence on the holiday so they can look into it for us :):T:T

Hopefully you'll get sorted and choose somewhere more suitable.

Next time before booking, ignore the sated transfer time quoted, it's pure nonsense, use google maps to give you an idea of travelling times between the airport and the hotel, then add at least an hour to it.
By the time they get everyone on the bus and have made a few stops en route, it adds up considerably.
One of the reasons I won't use coach transfers any more, I also don't do hold baggage as that takes too long for me :)
Change is inevitable, except from a vending machine.

    Rhetorical question:
why do people have important and strict selection criteria yet make no attempt to research and check that what is on offer is 100% correct and totally suitable?

Because-in theory - when they go to a Travel agent- that's what they are paying for:eek:

Someone else to get the facts right.

However, as has been proven may times, TA's are unreliable and at times untrustworthy.

It was reserched in that we searched for hotels within a certain travel distance from the airport. You'd hope that a reputable company such as first choice would have the facts correct - seems not.

as some one else pointed out , transfers can be long winded due to having to drop people off at several resorts. Have you tried googling it
